REMOVAL OF A BUS STOP CLEARWAY AND INTRODUCTION OF TWO NEW BUS STOP CLEARWAYS

Notice is hereby given that the Council of the London Borough of Enfield on 15th March 1999 made the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1, 1997) (Amendment No. 16) Traffic Order 1999 under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985 and the Road Traffic Act 1991. 2. The general effect of the Order will be further to amend the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1997 so that: (a) vehicles will be prohibited from stopping at any time of the day or night throughout the week on the areas of carriageway of the street specified in Schedule 1 to this notice and which area will be marked on the carriageway by a yellow “bus stop” marking and by a solid yellow line within that marking; (b) any existing restrictions on waiting by vehicles, on the sale of goods and on advertising activities imposed by the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1994 in the length of street specified in Schedule 2 to this notice will be revoked. 3. The prohibition referred to in paragraph 2 above will not apply: (a) to a public service vehicle operated by London Regional Transport or a vehicle being used to provide either a London local service or a London bus service, whilst picking up or setting down passengers; (b) to a vehicle being used for ambulance, fire brigade or police purposes; (c) in certain circumstances, to a vehicle being used in the service of a local authority, in connection with building operations, etc., adjacent to the bus stop or the removal of an obstruction to traffic or the repair, etc., of the highway or of any service therein; or (d) to a vehicle waiting for not more than 2 minutes to enable a person to board or alight or to load or unload his personal baggage. The limit of 2 minutes will not apply if the person has serious difficulty in walking or is blind; (e) where the person in control of the vehicle is required by law to stop or does so in order to avoid an accident; (f) to anything done with the permission or at the direction of a police constable or a parking attendant. 4. A copy of the Order, which will come into operation on 29th March 1999, of a map indicating the location and effect of the Order, of the Council’s statement of reasons for proposing to make the Order, of the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1994 and of the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1997 (and of the Orders which have previously amended or applied those Orders) can be inspected at the Reception Desk, “B” Block, the Civic Centre, Silver Street, Enfield, Middlesex EN1 3XD, during normal office hours on Mondays to Fridays inclusive until the end of 6 weeks from the date on which the Orders were made. 5. Copies of the Order may be obtained from Traffic Engineering, the Civic Centre, Silver Street, Enfield, Middlesex EN1 3XD. 6. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court. Schedule 1 New Bus Stop Clearways Lavender Hill : (a) the north side, from a point 24 metres east of a point opposite the eastern wall of No. 4 Lavender Gardens eastward for a distance of 19 metres; (b) the south side, from a point opposite the party wall of Nos. 126 and 128 Lavender Hill westward for a distance of 23 metres. Schedule 2 Bus Stop Clearway to be revoked Lavender Hill the south side, from a point 9 metres west of a point opposite the north-western wall of No. 122 Lavender Hill eastward for a distance of 19 metres. 15th March 1999.
