THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 89) ORDER 1999 THE BRENT (FREE PARKING PLACES) (NO. 1, 1995) (REVOCATION) ORDER 1999

Notice is hereby given that the Council of the London Borough of Brent, on 1st March 1999, made the above-mentioned Orders under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985. 2. The general effect of the “Waiting and Loading Restriction Amendment” Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that: (a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 1 to this Notice; (b) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 7 a.m. and 7 p.m. on Mondays to Saturdays inclusive in the length of streets specified in Schedule 2 to this Notice; (c) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive in the length of streets specified in Schedule 3 to this Notice; (d) waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will now be prohibited between 11 a.m. and 6.30 p.m.: (i) throughout the week in the lengths of streets specified in Schedule 1 to this Notice; (ii) on Mondays to Saturdays inclusive in the lengths of streets specified in Schedules 2 and 3; (e) the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of streets specified in Schedules 2 and 3) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected; (f) the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited; (g) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising, will be revoked. 3. The prohibitions referred to in sub-paragraph 2(a), (b), (c) and (d) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Orange Badge” will apply. 4. The general effect of the “Free Parking Places” Order will be to revoke the free parking place in Preston Waye imposed by the Brent (Free Parking Places) (No. 1) Order 1995. 5. A copy of each of the Orders, which will come into operation on 15th March 1999, of maps of the relevant areas, of the above-mentioned Orders of 1979 (and of the Orders which have amended those Orders) and 1995 can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at: (a)  The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middlesex HA9 9HX; and (b) The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middlesex HA9 6BZ. 6. Copies of the Orders may be purchased from the address mentioned in paragraph 5(b) above. 7. Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to either of the Orders may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.
