The A205 Trunk Road (Lewisham) Red Route (Bus Lane) Traffic Order 1998

The Traffic Director for London, following a direction given to him by the Secretary of State under section 58(1) of the Road Traffic Act 1991 to implement a Trunk Road Local Plan, hereby gives notice that he made the above-named Order under section 6 of the Road Traffic Regulation Act 1984 on 7th October 1998 which comes into effect on 16th October 1998.   The notice of Intent relating to this Order was published in The London Gazette on 20th August 1998. The general nature and effect of the Order as made is as described in that notice (except for minor modification) and will be to constitute on a permanent basis a bus lane on the south side of London Road in the London Borough of Lewisham, from the common boundary of 113 and 115 London Road westward for a distance of 151 metres and which will operate between 7 a.m. and 10 a.m. on Mondays to Saturdays inclusive.   Those controls will not apply to:   (a) a vehicle being used in the service of a local authority for the purpose of collecting refuse;   (b) a vehicle being used in the pursuance of any statutory duty of the Post Office for the purpose of collecting or delivering letters provided the vehicle bears the Royal Mail livery;   (c) a vehicle being used in connection with the removal of any obstruction to traffic;   (d) a vehicle being used in connection with the maintenance, improvement or reconstruction of any road;   (e) a vehicle being used in connection with the maintenance, improvement or construction of any street furniture including bus stop infrastructure;   (f) a vehicle being used in connection with any building operation or demolition;   (g) a vehicle being used in connection with the laying, erection, alteration or repair in or near the bus lane of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunications apparatus if the vehicle cannot be used for that purpose without being in the bus lane and insofar as the activity is not prohibited by the provisions of any Order made under the Road Traffic Regulation Act 1984;   (h) a vehicle entering or stopping in the bus lane so as to avoid an accident;   (i) a vehicle entering or stopping in the bus lane to allow a person to get or give help in consequence of an accident or emergency or otherwise take action for public safety;   (j) a vehicle crossing the bus lane in order to get to or from any road adjacent to the bus lane or any vehicular access to premises adjacent to the bus lane;   (k) a vehicle being in the bus lane to such an extent and for such a time as is needed to comply with any requirement resulting from works or an emergency in any part of the road adjoining the bus lane;   (l) a vehicle being used for ambulance, fire brigade or police purposes;   (m) a vehicle stopping in the bus lane if it has lawfully entered the bus lane and it has to stop:       (i) by law;       (ii) to avoid an accident;       (iii) in circumstances beyond the drivers control;   (n) anything done with the permission or at the direction of a police constable in uniform or a traffic warden.   The road affected by the Order is the A205 London Road.   A copy of the Order, a map indicating the location and effect of the Order and copies of the Order revoked can be inspected during normal office hours at the offices of the Traffic Director for London, College House, Great Peter Street, London SW1P 3LN, and the London Borough of Lewisham, One Stop Shop, Laurence House, 1 Catford Road, London SE6 4RU.   Any person desiring to question the validity of the Order or of any provision contained in it on the grounds that it is not within the relevant powers or that any of the relevant requirements have not been complied with in relation to the Order, may within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court.
