Barking Road Bus Lanes, The Newham (Bus Lanes) (No. 1) Experimental Traffic Order 1998
Notice is hereby given that the Council of the London Borough of Newham on 25th September 1998 made the above-mentioned Order under section 9 of the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985. 2. The general effect of the Order will be, by way of an experiment, to: (a) introduce bus lanes in Barking Road into the following areas of carriageway: (i) Barking Road E.6, the south-east side, from a point 15 metres south-west of the south-western kerb-line of Dickens Road to a point 65 metres south-west of the south-western kerb-line of St. Martin’s Avenue. This bus lane will operate from 7 a.m. to 10 a.m., on Monday to Friday inclusive and from 10 a.m. to 7 p.m. on Saturday and Sunday; (ii) Barking Road E.13, the north-west side, from a point 38 metres north-east of the north-eastern kerb-line of Credon Road to a point 2 metres south-west of the south-western kerb-line of Selsdon Road. This bus lane will operate from 4 p.m. to 7 p.m., on Monday to Friday inclusive and 10 a.m. to 7 p.m. on Saturday and Sunday; (b) prohibit all vehicles from being in the bus lanes referred to in (a) above during the operational hours stated above; the prohibition will not apply: (i) to a bus; (ii) to a pedal cycle; (iii) to a taxi; (iv) to a dial-a-ride bus; (v) to a vehicle being in a bus lane if and for as long as may be necessary: (A) to enable a person to get on or off the vehicle; or (B) to enable goods to be loaded on to or unloaded from the vehicle; if and in so far as the activity is not prohibited by the provisions of any other Order; (vi) in respect of a vehicle stopping in a bus lane if the vehicle is being used in: (A) the service of a local authority for the purpose of collecting refuse; (B) the pursuance of any statutory duty of the Post Office for the purpose of collecting or delivering letters provided the vehicle bears the Royal Mail livery; (C) connection with the removal of any obstruction to traffic; (D) connection with the maintenance, improvement or reconstruction of any road; (E) connection with the maintenance, improvement or construction of any street furniture including bus stop infrastructure; (F) connection with any building operation or demolition; (G) connection with the laying, erection, alteration or repair in or near the bus lane of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of telecommunications apparatus; if the vehicle cannot be used for that purpose without being in the bus lane and in so far as the activity is not prohibited by the provisions of any other Order made under the Road Traffic Regulation Act 1984. (vii) in respect of a vehicle being in a bus lane: (A) so as to avoid an accident; (B) to allow a person to get or give help in consequence of an accident or emergency or otherwise take action for public safety; (C) to such an extent and for such a time as is needed to comply with any requirement resulting from works or an emergency in any part of the road adjoining the bus lane; (D) if it is being used for ambulance, fire brigade or police purposes. (viii) in respect of: (A) a vehicle crossing a bus lane to get to or from any road adjacent to the bus lane or any vehicular access to premises adjacent to the bus lane; (B) anything done with the permission or at the direction of a police constable in uniform or a traffic warden. 3. The Order provides that subject to the provisions of section 10(2) of the Road Traffic Regulation Act 1984, the Council’s Director of Environment, Head of Environmental Engineering or some person authorised in that behalf by either officer, may if it appears to him or that person essential in the interests of the expeditious, convenient or safe movement of traffic or of the provision of suitable and adequate parking facilities on the highway or for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the Order or any provision thereof. 4. A copy of the Order, which will come into force on 19th October 1998, and of documents giving more detailed particulars of the Order, can be inspected during normal office hours on Mondays to Fridays inclusive with the period of 6 months from 19th October 1998 to 19th April 1999 in the office of the Director of Environment, 25 Nelson Street, East Ham, London E6 6EH, from whom copies of the Orders may also be obtained. 5 If any person wishes to question the validity of the Order or of any provision on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any requirements of the Act or of any instrument made under the Act has not been complied with, that person may, within 6 weeks from the date on which the Order was made, apply for the purpose to the High Court. 6 If the provisions of the Order continue in force for a period of not less than 6 months, the Council will consider in due course whether or not the provisions of the Order should be reproduced or continued in force indefinitely by means of an Order under section 6 of the said Act of 1984. Persons who wish to object to the making of an Order under section 6 of the said Act of 1984 for the purpose of such reproduction and continuation in force may, within the period of 6 months referred to in paragraph 4 above, send a statement in writing of their objection and the grounds thereof to the Director of Environment, 25 Nelson Street, East Ham E6 6EH, quoting the reference E/ES/NB.
