Ealing Road Controlled Parking Zone

Notice is hereby given that the Council of the London Borough of Brent, on 30th March 1998, made the above-mentioned orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Road Traffic Act 1991.
  2. The general effect of the “Waiting and Loading Restrictions” (Amendment) Order, will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:

  (a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 1 to this notice;
  (b) waiting by vehicles (including waiting for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 2 to this notice;
  (c) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8 a.m. and 9 p.m. throughout the week in the lengths of streets specified in Schedule 3 to this notice;
  (d) waiting by vehicles for the purpose of delivering or collecting goods or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11 a.m. and 6.30 p.m. throughout the week in the lengths of streets specified in Schedules 1 and 3 to this notice;
  (e) the sale or offer for sale of goods from a vehicle will be prohibited unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
  (f) the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising, will be prohibited;
  (g) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising, will be revoked in the lengths of streets specified in Schedules 1, 2 and 3 to this notice.

  3. The prohibitions referred to in paragraph 2(a) to 2(c) inclusive above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Orange Badge” will apply.
  4. The general effect of the “Restriction of Waiting on Bus Stops” (Amendment) Order will be to:

  (a) revoke existing Bus Stop Clearway Restrictions in the lengths of Ealing Road specified in Schedule 4 to this notice;
  (b) amend the Brent (Restriction of Waiting on Bus Stops) (No. 1) Traffic Order 1982, so that the restrictions on waiting by vehicles imposed by that Order will apply “at any time” to the bus stops which lie within the certain lengths of Ealing Road specified in Schdule 5 to this notice.

  5. The general effect of the “Parking Places” Order will be to:

  (a) designate parking places that will operate between 8 a.m. and 9 p.m. throughout the week in the lengths of streets specified in Schedules 6 and 7 to this notice;
  (b) specify that:
    (i) each parking place may be used, subject to the provisions of the Order, for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles, motor cycles or invalid carriages displaying a valid parking ticket or permit;
    (ii) the maximum initial period for which a vehicle, displaying a valid parking ticket may be left during the permitted hours in the parking places specified in Schedule 6 to this notice will be 2 hours;
    (iii) the charge for short term parking in the parking places specified in Schedule 6 to this notice will be 20 pence for 20 minutes, 40 pence for 40 minutes, £1 for 1 hour and £2 for 2 hours, the tickets for which will be issued by pay and display meters;
    (iv) the interval before a vehicle may again be left in a parking place after the expiration of the period for which the initial charge was incurred will be 2 hours;
    (v) any resident whose usual place of abode is in any street specified in Schedule 8 to this notice may apply to the Council for the issue of a resident’s permit valid for use in the parking places specified in Schedules 6 and 7 to this notice;
    (vi) no charge will be made for the first resident permit, which will be issued by the Council or its agents, to persons whose usual place of abode is in any street specified in Schedule 8 to this notice, for an initial period of 12 months. The charge for second and subsequent permits issued for the same residential postal address will be £17.50 for 6 months or £26 for 1 year running from the beginning of the month in which a permit becomes valid. The charge for the issue of a duplicate permit will be £5. Unexpired permits that have been paid for and surrendered to the Council will be entitled to a refund of £2.16 per month subject to a maximum refund of 3 months;
    (vii) any resident whose usual place of abode is in any street or part of street specified in Schedule 8 to this notice may apply to the Council for the issue of visitor’s permits valid for the period between 8 a.m. and 9 p.m. throughout the week, up to a maximum of 70 per annum per residential postal address at a cost of £1 per permit per day of use. No refunds will be made;
    (viii) any resident whose usual place of abode is in any street or part of street specified in Schedule 8 to this notice may apply to the Council for the issue of one free visitor’s permit, per annum per residential postal address valid for the period between 6.30 p.m. to 9 p.m. Mondays to Saturdays and 8 a.m. to 9 p.m. on Sundays. Additional daily dated permits will cost £3 per single or multiple application;
    (ix) any person who occupies premises in any street specified in Schedule 8 to this notice and who uses such premises for non-residential purposes may apply to the Council for the issue of business permits valid for use in the residents/pay and display parking places in Norton Road and Stanley Avenue. The charge for such business permit will be £300 for a period of 12 months.

  6. The general effect of the “Goods Vehicles Free Loading Places” Order will be to:

  (a) designate free loading places in the lengths of streets specified in Schedule 9 to this notice to operate between 10 a.m. and 1 p.m. throughout the week (loading/unloading limited to 30 minutes, no return for 2 hours) and between 7 p.m. and 9 p.m. throughout the week;
  (b) designate free loading in the lengths of streets specified in Schedule 10 to this notice to operate between 1 p.m. and 4 p.m. throughout the week (loading/unloading limited to 30 minutes, no return for 2 hours) and between 7 p.m. and 9 p.m. throughout the week;
  (c) designate free loading places in the lengths of streets specified in Schedule 11 to this notice to operate between 10 a.m. and 4 p.m. throughout the week (loading/unloading limited to 30 minutes, no return for 2 hours) and between 7 p.m. and 9 p.m. throughout the week;
  (d) specify that goods carrying vehicles constructed or adapted for use for the carriage of goods or burden of any description and is not drawing a trailer, may be used, subject to the provisions of the Order, for the purpose of continuous loading and unloading during the permitted hours.

  7. The general effect of the “Disabled Persons’ Parking Places” Order will be to:

  (a) designate parking places in which vehicles authorised by the Order may be left without charge;
  (b) provide that the parking place specified in Schedule 12 will operate “at any time”;
  (c) provide that the parking places specified in Schedule 13 will operate between 10 a.m. and 1 p.m. and between 7 p.m. and 9 p.m. throughout the week;
  (d) provide that the parking places specified in Schedule 14 will operate between 1 p.m. and 4 p.m. and between 7 p.m. and 9 p.m. throughout the week;
  (e) provide that the parking places specified in Schedule 15 will operate between 10 a.m. and 4 p.m. and between 7 p.m. and 9 p.m. throughout the week;
  (f) specify, in respect of the parking places, that disabled vehicles displaying in the relevant position a disabled person’s badge (commonly referred to as “the Orange Badge”) issued by any local authority under the provisions of the Disabled Persons (Badges for Motor Vehicles) Regulations 1982 may be left therein;
  (g) provide that certain vehicles may wait in the parking places in certain circumstances, eg. to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes).

  8. A copy of each of the Orders, which will come into operation on 14th April 1998, of a map of the relevant areas, of the Brent (Restrictions of Waiting on Bus Stops) Orders of 1974 and 1982 and of the Brent (Waiting and Loading Restriction) Order 1979 (and of the Orders which have previously amended those Orders) can be inspected during normal office hours on Mondays to Fridays inclusive until the end of 6 weeks from the date on which the Orders were made at:

  (a) The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middlesex HA9 9HX;
  (b) The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middlesex HA9 6BZ; and
  (c) Ealing Road Library, Ealing Road, Wembley, Middlesex HA0 4BR.

  9. Copies of the Orders may be purchased from the address mentioned in paragraph 8(b) above.
  10. Any person desiring to question the validity of any of the Orders or of any provision contained therein, on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof, or of any relevant regulations made thereunder, has not been complied with in relation to any of the Orders may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.
