ROADS (SCOTLAND) ACT 1984

NOTICE IS HEREBY GIVEN THAT the City of Edinburgh Council propose to make an Order under Section 1(1) and 152(2) of the Roads (Scotland) Act 1984 redetermining the means of exercise of the public right of passage over the road described in the Schedule hereto.

The title of the Order is The City of Edinburgh Council (Lower Granton Road and Trinity Crescent, Edinburgh) (Redetermination of Means of Exercise of Public Right of Passage) Order 200 - RSO/09/23

A copy of the proposed Order and of the accompanying plan showing the road over which the means of exercise of the public right of passage is to be redetermined, together with a statement of the reasons for making the Order have been deposited at The City of Edinburgh Council, City Chambers Reception, High Street, Edinburgh.

Those documents are available for inspection free of charge from 29 December 2009 until 2 February 2009 during the hours of 9.30 am and 3.30 pm Mondays to Fridays inclusive.

Any person may, within 35 days from 29 December 2009, object to the making of the Order by notice, in writing, quoting reference RSO/09/ 23 to THE DIRECTOR OF CITY DEVELOPMENT, ( TRANSPORT ), Waverley Court, 4 East Market Street, EDINBURGH EH8 8BG.

Objections should state the name and address of the objector, the matters to which they relate and the grounds on which they are made.

ROADS OVER WHICH MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE IS TO BE REDETERMINED FROM FOOTWAY TO CYCLE TRACK

Trinity Crescent (North to South Section)

East side . All that part of the footway on Trinity Crescent (North to South Section) from a point 10.5 metres or thereby south of the south building line of No 1 Trinity Crescent, measured along the kerbline, southwards for a distance of 16.5 metres or thereby and which has a width throughout of 2 metres or thereby.

West side . All that part of the footway on Trinity Crescent (North to South Section) from a point 4 metres or thereby south the south building line of No1 Trinity Crescent, measured along the kerbline, southwards for a distance of 8 metres or thereby and which has a width throughout of 2 metres or thereby.

Footway adjacent to the east end of McKelvie Parade (South side) All that part of the footway adjacent to McKelvie Parade from a point 16 metres or thereby west of the intersection of the west building line of the sewage pumping station and the south boundary line of McKelvie Parade, measured along the northern boundary line, south-eastwards:(a) for a distance of 15 metres or thereby and which has a width which varies from 0 metres or thereby to 4 metres or thereby, then (b) for a distance of 8 metres or thereby and which has a width which varies from 4 metres or thereby to 2 metres or thereby, then (c)for a distance of 17 metres or thereby and which has a width which varies from 2 metres or thereby to 3 metres or thereby, and then (d) for a distance of 3 metres or thereby and which has a width which varies from 3 metres or thereby to 0 metres or thereby.

Trinity Crescent (access road to the sewage pumping station)

East side . All that part of the footway on Trinity Crescent (access road to the sewage pumping station) from a point adjacent to the gate into the sewage pumping station, measured along the kerbline, eastwards: (a) for a distance of 10 metres or thereby and which has a width which varies from 0 metres or thereby to 6 metres or thereby, and then (b) for a distance of 5 metres or thereby and which has a width which varies from 6 metres or thereby to 0 metres or thereby.

Trinity Crescent (East to West Section) North side

All that part of the footway on Trinity Crescent from a point 6 metres or thereby east of the extended east kerbline of Trinity Crescent (North to South Section), westwards: (a) for a distance of 3 metres or thereby and which has a width which varies from 0 metres or thereby to 2 metres or thereby, and then (b) for a distance of 14 metres or thereby and which has a width throughout of 2 metres or thereby.
