NOTICE is hereby given that an application was presented on 17 October 2008 to the Court of Session at the instance of Scottish Provident Limited, a company incorporated under the Companies Acts with its Registered Office at 301 St. Vincent Street, Glasgow, G2 5HN (the "Company"), under inter alia paragraph 5(1)(e) of Schedule 2C to the Insurance Companies Act 1982 and/or Section 112(1)(d) of the Financial Services & Markets Act 2000 (the "2000 Act ") seeking inter alia an Order (1) authorising the amendment of the Scheme which was sanctioned by the Court of Session on 13 July 2001 and under which the long-term insurance business of The Scottish Provident Institution was transferred to the Company (the "Existing Scheme ") and (2), in particular, releasing the Company from the obligations presently imposed upon it by the Existing Scheme.

The Existing Scheme is proposed to be amended by two insurance business transfer schemes (the "New Schemes ") in terms of the 2000 Act and under the first of which part of the long term business of the Company is to be transferred to The Royal London Mutual Insurance Society Limited; and under the second of which the remaining part of the business is to be transferred to Phoenix Life Limited. Applications to sanction the New Schemes have been presented to the High Court of Justice, Strand, London WC2A 2LL. Those applications are to be heard on 4 December 2008. In the present note to the Court of Session, the Court made an order dated 17 October 2008 that the application be advertised once in each of The Edinburgh Gazette and The Times newspapers and that any person claiming an interest in the application lodge Answers to it, if so advised, at the office of The Court of Session, 2 Parliament Square, Edinburgh EH1 1RQ within 21 days of the last of those advertisements.
