THE A7 TRUNK ROAD (SELKIRK TO LINDEAN JUNCTION) (REDETERMINATION OF MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE) ORDER 200

NOTICE IS HERBY GIVEN THAT the Scottish Ministers propose to make an order under sections 2(1) and 152(2) of the Roads Scotland Act 1984 redetermining the means of exercise of the public right of passage over the lengths of road described in the Schedule hereto.

The title of the order is The A7 Trunk Road (Selkirk to Lindean Junction) (Redetermination of Means of Exercise of a Public Right of Passage) Order 200[ ].

A copy of the proposed order and of the accompanying plan showing the lengths of road over which the means of exercise of the public right of passage is to be redetermined, together with a statement of the reasons for making the order have been deposited at the offices of Transport Scotland, Buchanan House, 58 Port Dundas Road, Glasgow G4 0HF and at the offices of Bear Scotland, 6A Dryden House, Bilston Glen, Loanhead EH20 9TY and Selkirk Library, Ettrick Terrace, Selkirk TD7 4LE. Those documents are available for inspection free of charge from 12th September 2008 to 31st October 2008 during normal business hours.

ANY PERSON may object to the making of this Order, by notice in writing, to the Chief Roads Engineer c/o Mark Paterson, Transport Scotland, Trunk Roads Network Management, 8th Floor, Buchanan House, Glasgow G4 0HF, stating the title of the Order and the grounds of objection. Any such notice must be received on or before 31st October 2008.

Roads Over Which Means of Exercise of Public Right of Passage is to be redetermined

1.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from opposite its junction with Raeburn Place in Selkirk to its junction with the B7014, Dunsdale Haugh: a distance of 468 metres or thereby.

2.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the B7014 Dunsdale Haugh to its junction with the private access to Bridgeheugh: a distance of 792 metres or thereby.

3.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the private access to Bridgeheugh Cottage to its junction with the private access opposite the southbound layby: a distance of 51 metres or thereby.

4.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the private access opposite the southbound layby to its junction with the Lindean Mill access road: a distance of 360 metres or thereby.

5.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the Lindean Mill access road to its junction with the private field access: a distance of 386 metres or thereby.

6.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the private field access to its junction with the private access to the Lindean Smithy Cottages: a distance of 15 metres or thereby.

7.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the private access to the Lindean Smithy Cottages to its junction with the private access to Smithy House: a distance of 37 metres or thereby.

8.  That length of footway on the west side of the A7 Edinburgh – Carlisle Trunk Road from its junction with the private access to Smithy House to its junction with the access to Sunderland Hall: a distance of 62 metres or thereby.

These lengths of road, currently footway, will become cycle track, the right of passage being exercisable on pedal cycle and foot only.
