ROADS (SCOTLAND) ACT 1984

THE MORAY COUNCIL (SECTION OF FORMER A96 ADJACENT TO BRODIE SERVICE STATION - STOPPING-UP) ORDER 2006

Notice is hereby given that The Moray Council, as Roads Authority, have made an Order under Section 68(1) of the Roads (Scotland) Act 1984. This Order has been confirmed by The Moray Council as an unopposed Order in accordance with a decision of the Environmental Services Committee on 22 November 2006, in terms of the 1984 Act, having been advertised in the prescribed form with no objections being received.

The effect of the said Order, as confirmed, will be to “stop up” the following sections of road:-

Area A - From a point ‘a’ on the centre line or thereby, of the wall fronting Brodie Countryfare, in a north-easterly direction, in a straight line to a point 5.0m or thereby from the Railway boundary, thence eastwards, parallel to the Railway boundary to a point 5.1m or thereby from the edge of the carriageway of the public road C9E, thence southwards following the radius of the C9E at a distance of 5.1m or thereby from the edge of the carriageway to a point 4.0m ot thereby from the kerbline of the Trunk Road A96, thereafter in a westerly direction for a distance of 35.0m or thereby, parallel to and at a distance of 4.0m of thereby, from the edge of the carriageway of the Trunk Road A96 thereafter to point behind the wall at the west side of the eastmost access to the Filling Station, thence in a straight line to join point ‘a’ behind and on the approximate centreline or thereby of the wall fronting Brodie Countryfare to point ‘a’; and

Area B - From point ‘b’ situated at a distance of 2.0m or thereby from the edge of the carriageway of the public road C9E and 12.0m or thereby from the Railway boundary, in an easterly direction in front of the former Station House to a point on the east boundary of the former Station House, 5.7m or thereby from the edge of the carriageway of the Trunk Road A96, thereafter eastwards again to the boundary of Cranna House and Viewfield at a distance of 2.9m or thereby from the edge of the carriageway of the Trunk Road A96 thence in a westerly direction to a point opposite the former Station House east boundary at a distance of 2.1m or thereby from the edge of the A96 carriageway, thereafter in a westerly direction for a distance of 22.0m to thereby to a point 2.5m from the A96 carriageway edge, thereafter in a northerly direction, parallel to the edge of the A96 and then the C9E to the point ‘b’ situated at a distance of 2.0m or thereby from the edge of the carriageway of the public road C9E and 12.0m or thereby from the Railway boundary.

All as shown on the plan attached to the Order.

A copy of the Order, as confirmed, and of the plan referred to therein have been deposited at The Moray Council Access Point, Council Office, Greyfriars Street, Elgin and may be inspected there free of charge during normal opening hours.

Any person aggrieved by the Order, as confirmed, may apply to the Court of Session before 12 January 2007 to have the Order, as confirmed, quashed on the basis that the Order is not within the powers of the Act or that their interests have been substantially prejudiced by a failure to comply with the requirements of the Act or that the Tribunal and Inquiries Act 1992, or any Orders, Rules or Regulations under these Acts.
