THE TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997

THE LAIGH FENWICK (WEST) (PROVISIONAL) TREE PRESERVATION ORDER (NO 2) 2005

East Ayrshire Council acting under the powers conferred on them by Sections 160, 161 and 163 of the Town and Country Planning (Scotland) Act 1997 and of all other powers enabling them in that behalf and subject to the Forestry Act 1967, on the Tenth day of November Two Thousand and Five made the Laigh Fenwick (West) (Provisional) Tree Preservation Order (No 2) 2005 in worthy protection from felling trees and woodlands on the western side of Laigh Fenwick. These trees form an important backdrop to Laigh Fenwick the majority being within an area which, under proposal PROP 28 of the East Ayrshire Local Plan, are included within an amended boundary of the Laigh Fenwick Conservation Area. The trees which are the subject of this Order form a valuable screen for residential properties within Laigh Fenwick from the M 77. Some of the trees also enhance the setting of Fenwick Bowling Club.

This Order contains a direction under Section 163 of the Town and Country Planning (Scotland) Act 1997 the effect of which is that the said Order took effect provisionally on the Tenth day of November Two Thousand and Five, and shall continue in force until the expiration of a period of six months beginning with the date the Order was made or until the date on which the Order is confirmed, whichever first occurs.

A Certified copy of the said Tree Preservation Order and relative map may be inspected at the Planning, Development and Building Standards Division, 6 Croft street, Kilmarnock between the hours of 9.00 am and 5.00 pm from Monday to Thursday and 9.00 am to 4.00 pm on Fridays.

You may make objections or representations with respect to the Order to the Planning, Development and Building Standards Division at the above address in accordance with Regulation 7 of the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 1975 as amended by the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Amendment Regulations 1981.
