THE TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997

THE B 751, FENWICK ROAD, ROWALLAN (BY KILMAURS) (PROVISIONAL) TREE PRESERVATION ORDER 2005

East Ayrshire Council acting under the powers conferred on them by Sections 160, 161 and 163 of the Town and Country Planning (Scotland) Act 1997 and of all other powers enabling them in that behalf and subject to the Forestry Act 1967, on the Eighteenth day of January Two Thousand and Five made the B 751, Fenwick Road, Rowallan (by Kilmaurs) (Provisional) Tree Preservation Order 2005 in worthy protection from felling the trees forming a line on the south side of Fenwick Road (B751) opposite the lodge gates and woodland at Rowallan then extending eastwards as an avenue along both sides of the B751 to its junction at the Old Schoolhouse, Fenwick Road. The trees are predominantly sycamores planted simultaneously about 50 years ago and together form an attractive feature of the approach to the lodge gates at Rowallan.

This Order contains a direction under Section 163 of the Town and Country Planning (Scotland) Act 1997 the effect of which is that the said Order took effect provisionally on the Eighteenth day of February Two Thousand and Five, and shall continue in force until the expiration of a period of six months beginning with the date on which the order was made or until the date on which the Order is confirmed, whichever first occurs.

A Certified copy of the said Tree Preservation Order and relative map may be inspected at the Planning, Development and Building Standards Division, 6 Croft Street, Kilmarnock, between the hours of 9.00 am and 5.00 pm from Monday to Thursday and 9.00 am to 4.00 pm on Fridays.

You may make objections or representations with respect to the Order to the Planning, Development and Building Standards Division at the above address in accordance with Regulation 7 of the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 1975 as amended by the Town and Country Planning (Tree Preservation Order and Trees in Conservation areas) (Scotland) Amendment regulations 1981.

REGULATION 7

(1)  Every objection or representation to the Planning Authority with respect to an Order shall be made in writing, shall state the grounds thereof and specify the particular trees, group of trees or woodlands in respect of which it is made

(2)  An objection or representation shall be duly made if it complies with paragraph (1) of this Regulations Authority within 28 days from the date of the service of the notice of the making of the Order or the date of the publication of the notice by advertisement as the case may be.
