Notice of Amendment to the gas conveyance element of the Phoenix Natural Gas Limited combined licences for the conveyance and supply of gas in Northern Ireland

The Department of Enterprise, Trade and Investment (hereinafter referred to as “the Department”) hereby gives notice as follows:

The Department proposes to amend the gas conveyance element of the Phoenix Natural Gas Limited combined licences for the conveyance and supply of gas in Northern Ireland granted to Phoenix Natural Gas Limited (hereinafter referred to as the “licensee”).

Directive 2003/55/EC required the separation of gas distribution and supply functions within Phoenix Natural Gas. This resulted in the establishment of Phoenix Supply Limited as a separate gas supply company. Amendments are therefore necessary to the conveyance element of the combined licences in order to remove references to gas supply activities.

As part of the agreement reached with the licensee in November 2006 to reform their regulatory regime, it was agreed that the licensee would sell its transmission business. The sale of the Phoenix Transmission asset in March 2008 therefore requires amendments to the conveyance element of the combined licences.
