THE EMPLOYMENT RELATIONS (2004 ORDER) (COMMENCEMENT NO. 4 AND TRANSITIONAL PROVISIONS) ORDER (NORTHERN IRELAND) 2005 – SR. 2005 No. 571 (C. 39)

Notice is hereby given that the Department for Employment and Learning, in exercise of the powers conferred on it by Article 1(2) and (3) of the Employment Relations (Northern Ireland) Order 2004, and of all other powers enabling it in that behalf, has made a Statutory Rule entitled the Employment Relations (2004 Order) (Commencement No. 4 and Transitional Provisions) Order (Northern Ireland) 2005 – S.R 2005 No. 571 (C. 39) (“the Order”).

The Order, which corresponds to the GB Statutory Instrument the Employment Relations Act 2004 (Commencement No. 4 and Transitional Provisions) Order 2005, brings into operation on 8 January 2006, Articles 5 and 8 and paragraphs 9, 10 and 13 of Schedule 1 to the Employment Relations (Northern Ireland) Order 2004 (“the 2004 Order”).

Paragraphs 9, 10 and 13 of Schedule 1 to the 2004 Order contain provisions which amend Schedule 1A to the Trade Union and Labour Relations (Northern Ireland) Order 1995 (“the 1995 Order”). These relate to unfair practices in relation to trade union recognition and derecognition ballots and additional duties on employers informed of ballots.

Articles 5 and 8 of the 2004 Order contain provisions which amend Articles 105 and 118 of the 1995 Order. These relate to information about employees, to be balloted on industrial action and to be contained in notice of industrial action.

The Order contains a number of transitional provisions to deal with particular matters which are on-going at the time of commencement.
