Notice is hereby given that HealthSure, BCWA and HSA presented an application to the High Court of England and Wales (the Application) pursuant to Part VII of the Financial Services and Markets Act 2000 (FSMA) for an order:

(1) under section 111 FSMA sanctioning the Scheme (the Scheme) for the transfer to HSA of all the insurance business conducted by HealthSure and BCWA and as at 31 December 2005; and
(2) under section 112 FSMA making ancillary provisions to implement the Scheme.

A report (the Report) has been prepared by an independent expert, John O’Neill of Mazars LLP, a Fellow of the Institute of Actuaries, in pursuance of section 109 FSMA. A copy of the Report, a summary of the Report and a statement setting out the terms of the Scheme can be obtained free of charge by calling 0800 0721000. These documents are also available on the HSA website, www.hsa.co.uk, or can be obtained from The Company Secretary at HSA Group Limited, Hambleden House, Waterloo Court, Andover, Hampshire, SP10 1LQ.

The Application will be heard on 19 December 2005 before a Judge of the Chancery Division at the Royal Courts of Justice, Strand, London WC2A 2LL. Any person, including any employee of HSA, HealthSure or BCWA or who claims to be adversely affected by the carrying out of the Scheme, is entitled to appear, in person or by Counsel. If any such person intends to appear in Court they are asked to give not less than two clear days’ notice of their intention to do so, together with their reasons for objecting to the transfer, to the solicitors named below.
