By order of ICC Judge Agnello KC, the proceeding commenced in Spain pursuant to Art. 585 of the Real Decreto Legislativo 1/2020, de 5 de mayo, por el que se aprueba el texto refundido de la Ley Concursal has been recognised as a foreign main proceeding pursuant to Article 17 of the UNCITRAL Model Law on cross-border insolvency as set out in Schedule 1 to the Cross-Border Insolvency Regulations 2006 (the "Model Law").

Pursuant to Articles 20(6) and 21(1)(g) of the Model Law, the stay and suspension in Article 20(1) of the Model Law is modified and additional relief has been granted on the terms set out in the order such that:

1) No step may be taken to enforce security over the Debtor’s property except with the consent of the foreign representative of the Debtor or with the permission of the court;

2) No step may be taken to repossess goods in the Debtor's possession under a hire-purchase agreement except with the consent of the foreign representative or with the permission of the court;

3) No legal process may be instituted or continued against the Debtor or its property except with the consent of the foreign representative or with the permission of the court;

4) An administrative receiver of the Debtor may not be appointed;

5) No winding-up petition may be presented, proceeded with or advertised except with the consent of the foreign representative of the Debtor or with the permission of the court, and no order may be made for the winding up of the Debtor save as identified by paragraph 42(4) of Schedule B1 Insolvency Act 1986 (and paragraph 42(5) of Schedule B1 shall apply);

6) No person may apply for the appointment of an administrator, or appoint (or take any steps in respect of the appointment of) an administrator, in respect of the Debtor except with the consent of the foreign representative or with the permission of the court; and

7) A landlord may not exercise a right of forfeiture by peaceable re-entry in relation to premises let to the Debtor except with the consent of the foreign representative or with the permission of the court,

but the preceding restrictions shall not apply in respect of assets to which the International Interests in Aircraft Equipment (Cape Town Convention) Regulations 2015 apply after the end of the "waiting period" defined in Regulation 37 of those Regulations. Nothing in the order affects rights provided for, protected by, or exercisable consistently with those Regulations. The order applies only in Great Britain and does not have extra-territorial effect.
