By Order of the High Court of Justice, Business and Property Courts of England and Wales, Insolvency and Companies List (ChD), the case under chapter 11 of title 11 of the United States Code in respect of LIV Golf Ltd commenced on 8 September 2026 in the United States Bankruptcy Court for the District of New Jersey and jointly administered under In re LIV Golf New Jersey LLC, et al., Case No. 26-20189, has been recognised as a foreign main proceeding pursuant to Article 17 of the UNCITRAL Model Law on cross-border insolvency as set out in Schedule 1 to the Cross-Border Insolvency Regulations 2006 (the Model Law).

Pursuant to Articles 20(1), 20(6) and 21(1) of the Model Law and paragraphs 42 and 43 of Schedule B1 to the Insolvency Act 1986, the stay and suspension in Article 20(1) of the Model Law is modified and additional relief has been granted in the terms set out in the order, including that no winding up petition may be presented or winding up order made in respect of LIV Golf Ltd except with the consent of the foreign representative of LIV Golf Ltd or the permission of the court, that the stay is the same in scope and effect as if LIV Golf Ltd had entered into administration under Schedule B1 to the Insolvency Act 1986, and that Article 20(1)(c) of the Model Law is disapplied so that there is no suspension of LIV Golf Ltd’s right to transfer, encumber or otherwise dispose of its assets
