NOTICE TO CREDITORS OF AN INSOLVENT COMPANY REGARDING THE RE-USE OF A PROHIBITED NAME

On 16 August 2024, the Company entered into creditors’ voluntary liquidation.
I, WALID FAKHRY of 2 Lancaster Drive, London, NE3 4HA, was a director of the Company on the day it entered into creditors’ voluntary liquidation.
I give notice that I intend to act in all or any of the ways specified in section 216(3) of the Insolvency Act 1986 in connection with, or for the purposes of, the carrying on of the whole or substantially the whole of the business of a company named Ben Cruachan Limited (company no: 15050372) under the following names: "MILROY’S", “MILROY’S OF SOHO” and/or “MILROY’S OF GREEK STREET”.
It should be noted that I would not otherwise be permitted to undertake those activities without the leave of the court. Breach of the prohibition created by section 216 of the Insolvency Act 1986 is a criminal offence.
Accordingly, on 25 February 2026, I filed an application in the High Court of Justice, Business and Property Courts in Bristol, Insolvency and Companies List (ChD) (the “Application”), seeking leave of the Court for permission to act as a director or otherwise be concerned or take part in the promotion, formation, management of Ben Cruachan Limited which, if the Application is successful, intends to be known by the names MILROY’S", “MILROY’S OF SOHO” and/or “MILROY’S OF GREEK STREET”. "The Application is listed to be heard remotely via Microsoft Teams on 2 June 2026 at 11am under case number CR-2026-BRS-000026.
