EXPERIMENTAL INTRODUCTION OF SUTHERLAND ROAD E17 (T12(24)) CONTROLLED PARKING ZONE (CPZ)
1. NOTICE IS HEREBY GIVEN that the London Borough of Waltham Forest (the Council) on 21st November 2024 made The Waltham Forest (Charged-For Parking Places) (Amendment No. 229) Experimental Order 2024 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 225) Experimental Order 2024 under sections 9 and 10 of the Road Traffic Regulation Act 1984. The Orders will come into force from 6th December 2024 and each order may continue in force for up to 18 months.
2. The general effect of the Orders referred to in paragraph 1 above will be, as an experiment, to:-
(a) suspend all "at any time" waiting restrictions in Sutherland Road (SUH) between St Andrews Road and Stirling Road except the double yellow lines on the (1) south side - across the entrance between Nos. 31 and 33 SUH and (2) west side – between a point 18 metres south of the southern kerb line of Andrews Road and No. 79 SUH and (3) outside No. 71 SUH;
(b) provide a new CPZ in Sutherland Road E17 (between its junctions with St Andrews Road and Stirling Road E17) comprising new ‘SR’ permit holders parking places (western and southern sides), which would operate between the hours of 8.00 a.m. and 6.30 p.m. Mondays to Saturdays, except where new (1) "at any time" waiting restrictions and (2) a loading place are provided;
(c) provide new inset Disabled Persons Parking Places (eastern and northern sides) operating “at any time’ located (i) outside No. 30 SUH, (ii) opposite Nos. 63/65 SUH and (iii) outside No. 22 SUH;
(d) provide a “loading only” place outside Nos. 59/61 SUH operating “at any time” with a maximum stay of 40 minutes and no return within 1 hour of leaving;
(e) introduce new lengths of (1) "at any time" no waiting restrictions (western and southern sides) and (2) no waiting and loading "at any time" restrictions (eastern and northern sides) between all parking and loading places referred to in items 2(b), 2(c) and 2(d) preceding (except where raised tables have been provided* and where existing lengths of double yellow line have not been suspended);
(f) provide that the properties eligible to apply for parking permits and visitor permits in the Sutherland Road ‘SR’ (permit identifier) CPZ are specified in Schedule 1 of this notice (see the various parking permits in Schedule 2) (properties defined as ‘car free’ under agreed planning conditions would be eligible for visitor permits only);
*Parking on a raised section of highway above the existing highway is a contravention and is prohibited under section 86 of The Traffic Management Act 2004 (exceptions apply).
3. The Orders will provide that –
(a) residents' permits, business permits, charity permits, visitors' permits, school staff term-time only permits, residents’ foreign vehicle permits and essential user/carers permits may be issued, on payment of the appropriate charge as specified in paragraph 6 below, to a person who is the keeper of a passenger vehicle (having 8 passenger seats or less), certain goods carrying vehicles and invalid carriages, providing that in the case of -
(i) a residents' permit, they are a resident of a property eligible to purchase permits as listed in the relevant Schedule to this Notice and their vehicle is UK registered to that address;
(ii) a foreign vehicles residents' permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is registered outside of the UK;
(iii) a business/charity permit/business visitor’s permit, they have a business in a property eligible to purchase permits as listed in the relevant Schedule to this Notice and that the permit is for a vehicle which is essential to the operation of that business/charity and is used in the purchase and sale of goods or services in connection with that business/charity;
(iv) an essential users/carers permit, they are a doctor or carer who has a surgery in or works in the London Borough of Waltham Forest, or employed by or contracted to the Council, or employed by or contracted to a health authority, or employed by the Metropolitan Police, or employed by the London Fire and Civil Defence Authority, or a company that services fire-fighting appliances and for whom the use of a vehicle is essential to the carrying out of their public service duties in a street or part of a street specified in paragraph 2(b) above;
(v) a school staff term-time only permit, they are a registered member of staff at a primary or secondary school situated in a street or part of a street specified in paragraph 2(b) above, who has a bona fide reason to drive to that school and who lives or is based outside the Borough;
(b) vehicles displaying any valid permit displaying the letters: SR may use the permit parking places provided in the street specified in paragraph 2(b) above;
4. The properties specified in Schedule 1 to this Notice will be eligible in respect of permits to park in the SR CPZ.
5. Where it appears necessary for certain purposes, an authorised officer of the Council may, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, modify or suspend any provision of the experimental Traffic Orders while they are in force.
6. Documents giving more detailed particulars of the measures and copies of the Orders can be inspected on request by emailing traffic.scheme@walthamforest.gov.uk during normal office hours on Mondays to Fridays inclusive, from 21st November 2024 until the Orders cease to have effect, or online at: www.walthamforest.gov.uk/content/road-traffic-schemes-and-consultations.
7. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent to Traffic Orders, Highways, Low Hall, Argall Avenue, London, E10 7AS, or by emailing: traffic.scheme@walthamforest.gov.uk quoting in respect of an Order referred to in paragraph 1 above, reference T12(24) – SUTHERLAND ROAD (SR) CPZ. Any objection may be communicated to, or be seen by, other persons who may be affected.
8. If any person wishes to question the validity of any of the Orders or of any of their provisions on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Orders are made, apply for the purpose to the High Court.
