NOTICE OF VARIATION OF CONSERVATION AREA

PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990, SECTION 69 (2) AND 70 (8)

LEGH ROAD, KNUTSFORD; HOLMES CHAPEL; BOLLIN HILL, WILMSLOW, GAWSWORTH CONSERVATION AREA EXTENSIONS AND AMENDMENTS

CHESHIRE EAST BOROUGH COUNCIL hereby gives NOTICE in accordance with section 70 of the above-named Act of the variation of the designated Legh Road, Bollin Hill, Gawsworth and Holmes Chapel Conservation Area by the inclusion and exclusion of the following areas:

The Legh Road Conservation Area boundary be extended to include:

• Bexton Cottage, White Gates, Bexton Mews and Land at junction of Bexton Lane and Woodvale Road.

• 19/21 Chelford Road and 29-49 Chelford Road, High Trees, Windle and Cottage Chelford Road.

The Bollin Hill Conservation Area boundary be extended to include:

• Number 9 Styal Road and the north section of Cliff Road to the junction of Styal Road.

The Holmes Chapel Conservation Area boundary be amended with:

• Removal of 27-39 Bessan Court (to the rear of supermarket car park)

• Inclusion of Numbers 8-22 Macclesfield Road (south side) and land to the rear of properties and The Smithy. 1-15 Macclesfield Road (North Side) and land associated.

The Gawsworth Conservation Area boundary be extended to include:

• Land at New Hall Farm.

• Northern approach to Gawsworth Hall along Church Lane, including tree lined avenue to both sides of Church Road.

The principal effects of these variations are as follows:

1. The Council is required to prepare proposals to ensure the preservation or enhancement of the Area under Section 71 of the Act.

2. In carrying out its functions under the Planning Acts, the Council and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area under section 72 of the Act.

3. Special publicity must be given to planning applications for development in the area and representations received taken into consideration in their determination under section 67 of the Act.

4. Planning permission must be obtained from the Council for the demolition of any unlisted building where the total volume is more than 115m3 and for the demolition of walls, gates and fences more than 1m high next to a highway or 2m elsewhere.

5. Six weeks written notice must be given to the Council before works are carried out to any tree in the area with a trunk diameter greater than 75mm at 1.5 metres above ground level and that is not protected by a Tree Preservation Order.

6. Permitted development rights under the Town and Country Planning (General Permitted Development) (England)Order 2015 are more restricted in the Conservation Area.

7. The right to display certain types of advertisements without express advertisement consent is excluded under the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 (as amended).
