PENALTY CHARGE NOTICE ENFORCEMENT OF PARKING RESTRICTIONS IN COUNCIL HOUSING ESTATE CAR PARKING AREAS

THE ISLINGTON (OFF-STREET PARKING PLACES) (HOUSING ESTATES) (AMENDMENT NO. *) ORDER 2024

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Islington proposes to make the above-mentioned Order under Sections 32, 33 and 35 of the Road Traffic Regulation Act 1984 as amended.

2. The general effect of the order will be to formalise the existing parking restrictions in the Council’s housing estate car parks and access roads within the estates listed in Schedules 1 and 2 to this notice, so as to allow for penalty charge notice parking enforcement under the provisions of the Traffic Management Act 2004.

3. The restrictions in the estates listed in the schedules to this notice will be:

(a) No vehicles may park in any area indicated as being a ‘restricted area’ by the marking of either cross-hatching or ‘keep clear’ markings;

(b) No vehicles may park in any area indicated as being a ‘restricted area’ by the marking of double-yellow lines, except for vehicles parked for the purposes of loading and unloading;

(c) Where parking bays are marked, all vehicles must be parked within the limits of a marked parking bay;

(d) Where it is indicated that an estate bay holder permit parking scheme is in operation, all vehicles (other than those left in bike hangars, marked motorcycle bays, authorised vehicle bays or marked disabled person’s parking bays) left parked:

(i) in a resident bay must display either a valid bay holder permit or valid bay holder visitor voucher; and

(ii) in a shared use bay must display either a valid temporary permit or valid visitor voucher;

(e) Where a parking bay is marked as being for disabled persons only, only vehicles displaying a valid ‘blue badge’ may be left in that parking bay;

(f) Where a parking bay is marked as being for motor cycles only, only vehicles of that class may be left in that parking bay;

(g) Where bike hangars are provided only pedal cycles may be left in a bike hangar; and,

(h) Where a parking bay is marked as being for authorised vehicles only, only liveried council vehicles or vehicles displaying a permit indicating their use by the council.

4. The charges for bay holder parking permits and visitor vouchers shall be as follows:

In addition to the above:

(a) A surcharge of £160 per annum (£3.08 per week) applies in respect of permits issued in relation to diesel fuelled vehicles;

(b) In respect of permits, VAT may be payable in addition to the amounts listed above; and

(c) Some discounted charges are available for Islington Council blue disabled badge holders, those who are 60 years of age or over and those in receipt of Disability Living Allowance or Personal Independence Payments.

7. Any person who wishes to object or to make other representations about the proposed Orders should send a statement in writing, specifying the grounds on which any objection is made, to Environment, 1 Cottage Road, London N7 8TP (quoting reference 7862), within the period of twenty-one days from the date on which this Notice is published.
