DESIGNATION OF THE SMITHS GREEN CONSERVATION AREA

NOTICE OF DESIGNATION

1. NOTICE IS HEREBY GIVEN THAT Uttlesford District Council on the 2 November 2023 resolved to designate the Smiths Green Conservation Area under the Planning (Listed Buildings and Conservation Areas) Act 1990 sections 69, 70 and 71. The Council published the proposals on 31 July 2023 and held a public meeting in The Old School Community Centre, Brewers End, Takeley on 9 September. The consultation period lasted from 31 July 2023 to 29 September 2023 and the Council had regard to the views expressed in that meeting and any written representations when making the resolution.

2. The following areas have been designated as the Smiths Green Conservation Area:

Properties to the east and west of Smiths Green Lane and bounded at the south by the B1256.

The principal effects of the designation of a conservation area are as follows:

a. It preserves or enhances the character and appearance of the conservation area as an area of special architectural or historic interest and the Council is under a duty to formulate its proposals for its preservation or enhancement.

b. In carrying out any functions under the Planning Acts in relation to conservation areas (and in particular determining applications for planning permission and listed building consent) the Council is under a duty to pay special attention to the desirability of preserving or enhancing the character or appearance of those areas.

c. Consent is required for the demolition of any building and may be needed for demolition of gates, fences walls and railings. It is a criminal offence to carry out demolition in a conservation area without planning permission.

d. Consent is required for certain external works to dwelling houses which would otherwise be “permitted development” as defined in the Town and Country Planning (General Permitted Development) (England) Order 2015.

e. Consent is required to carry out works to trees and six weeks’ notice in writing must be given to the Council before any works are carried out to a tree in a conservation area. It is a criminal offence to cut down, lop, top or uproot a tree in a conservation area without giving this written notice.

f. There are certain restrictions over the display of outdoor advertisements.

3. A map of the Conservation Area as now designated can be found on Council’s website: www.uttlesford.gov.uk and may be inspected free of charge together with associated documents during normal office hours at: Uttlesford District Council, London Road, Saffron Walden CB11 4ER.
