THE CROYDON (ON-STREET CHARGED-FOR PARKING PLACES) (NO.7) EXPERIMENTAL ORDER 2022

1. NOTICE IS HEREBY GIVEN that the London Borough of Croydon on 19 September 2022 made the abovementioned Orders under Section 9 of the Road Traffic Regulation Act, 1984 as amended by the Local Government Act, 1985.

2. The general effect of the Orders would be to experimentally introduce the following measures to facilitate a “Croydon Healthy Neighbourhood” (CHN) to replace the existing temporary traffic scheme in the Holmesdale Road area:

(a) To introduce a permanent closure to all motor vehicles (with the exception of the emergency services) at the common boundary of Nos. 236 and 238 Holmesdale Road, adjacent to its junction with the south-western kerb-line of Park Road, marked by lockable bollards.

(b) To introduce CCTV camera enforced restrictions to prohibit motor vehicles (with the exception of buses, taxis and permit holders, “HR”) from access to and egress from:

(i) Elm Park Road at its junction with South Norwood Hill (closure points at the north-eastern boundary of No. 57 South Norwood Hill and at a point 4 metres south-west of that boundary).

(ii) Holmesdale Road at its junction with the north-eastern kerb-line of Park Road (closure points at the south-western boundary of No. 19 Upper Grove and at the common boundary of Nos. 235 and 237 Holmesdale Road).

(iii) Holmesdale Road opposite the south-western flank wall of No. 371 (closure point opposite the flank wall).

(c) To introduce waiting and loading restrictions operating “at any time”:

(i) in Elm Park Road on both sides between its junction with South Norwood Hill and a point 15 metres south-west of that junction (replacing one disabled bay).

(ii) in South Norwood Hill on the south-west side for 5 metres either side of its junction with Elm Park Road.

(iii) in Holmesdale Road on both sides between its junction with Park Road and the common boundary of Nos. 239 and 241 Holmesdale Road (replacing three permit/payment bays).

(iv) in Park Road (loading restrictions only) on the north-east side, for 9.5 metres either side of its junction with Holmesdale Road.

(v) in Holmesdale Road on both sides from a point 4.5 metres north-east of the common boundary of Nos. 367 and 369 for a distance of 22.5 metres north-eastwards (replacing six permit/payment bays).

(d) To relocate/remove parking bays as follows:

(i) The disabled bay in Elm Park Road adjacent to No. 55 South Norwood Hill will be relocated 6 metres south-west of its current location, to be situated at the end of the new waiting and loading restrictions at the junction of Elm Park Road and South Norwood Hill.

(ii) Three permit/payment bays outside Nos. 235 to 239 Holmesdale Road will be replaced by two bays outside Nos. 241 and 243 Holmesdale Road and two bays adjacent to No. 28 Upper Grove.

(iii) Six permit/payment bays (two outside Nos. 371 to 373 Holmesdale Road, and four opposite Nos. 369 to 373 Holmesdale Road) will be removed.

(e) To amend the map-based tiles to the Schedules attached to the above Orders so as to accurately represent the new arrangements as they exist on site.

(f) In addition to buses, licensed taxis and permit holders, the prohibited access restriction will not apply to the emergency services, refuse vehicles, or vehicles being used for the purposes of a statutory undertaker in an emergency (such as the loss of utility supplies to premises in the area, which requires vehicles to be brought into a section of road to which the order applies). Permits will be available free of charge to residents within the “HR” exemption zone, as well as Blue Badge holders, District Nurses, carers, and school staff. Further exemptions may be added or removed as the scheme progresses. More detailed information about permit eligibility is available on our website at www.croydon.gov.uk/healthyneighbourhoods.

3. Copies of the Orders, which will come into operation on 30 September 2022, and of the Council's statement of reasons for proposing the scheme and of the plans which indicate the lengths of road to which the scheme relates, can be inspected by appointment with the Parking Design Team, at Bernard Wetherill House, 8 Mint Walk, Croydon, CR0 1EA (telephone 020 8726 6000 and ask for Parking Design). Alternatively all related documents or further information can be requested by email to Parking.Design@croydon.gov.uk.

4. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act, 1984 or that any of the relevant requirements thereof or of any relevant regulations made there under have not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

5. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of Orders made under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to The Road Traffic Regulation Act, 1984, as amended, and all other enabling powers. Any person may object to the making of the Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the experimental Orders come into force (i.e., by 30 March 2023) or, if the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be in writing, quoting the reference PD/CHN/Holmesdale Road Area, must state the grounds on which it is made and be emailed to holmesdale.hn@croydon.gov.uk, or posted to the Parking Design Team, at Bernard Wetherill House, 8 Mint Walk, Croydon, CR0 1EA.
