(NOTE: This notice is about making changes to the School Streets Scheme in College Road, Preston Park, which is currently enforced by an experimental traffic order. The extent of the pedestrian and cycle zone in College Road, Preston Park will be changed so that the zone will operate between the south-eastern kerb-line of Thirlmere Gardens and the north-western kerb-line of Carlton Avenue East, instead of the current extent which is between the south-eastern kerb-line of Thirlmere Gardens and the north-western kerb-line of Glendale Gardens. Objections may be made to these changes being continued on a permanent basis – see paragraph 6.)

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 21st September 2020 made the Brent (Prescribed Routes) (Pedestrian & Cycle Zone) (No. 5) Experimental Traffic Order 2020 (Variation No. 1) Experimental Variation Order 2020 (“the Variation Order”) under sections 9, 10 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. The Variation Order will come into force on 2nd October 2020.

2. The general effect of the Variation Order will be to vary the provisions of the Brent (Prescribed Routes) (Pedestrian & Cycle Zone) (No. 5) Experimental Traffic Order 2020 (“the original Experimental Traffic Order”), so as to change the extent of the pedestrian and cycle zone in College Road, Preston Park so that the extent of the zone becomes between the south-eastern kerb-line of Thirlmere Gardens and the north-western kerb-line of Carlton Avenue East. The operational hours remain the same.

3. The original Experimental Traffic Order imposed a pedestrian and cycle zone in College Road, Preston Park, between Thirlmere Gardens and Glendale Gardens, to create a pleasant environment that feels safer in the immediate vicinity of a school, discourages travelling to school by car in cases where alternative means of travel are available, and encourages walking and cycling to school, thereby achieving positive health outcomes for the school community. The Variation Order is required so that the length of the pedestrian and cycle zone is increased so students can benefit more from the effect created by the zone.

A copy of the Variation Order, the original Experimental Traffic Order and other documents giving detailed particulars about them (including maps) can be inspected during normal office hours on Mondays to Fridays inclusive until the original Experimental Traffic Order cease to have effect, at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ. 6. The Council of the London Borough of Brent will consider in due course whether the provisions of the original Experimental Traffic Order, varied as described above by the Variation Order, should be continued in force indefinitely by means of an Order made under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Order for the purpose of such indefinite continuation, within a period of six months beginning with the date on which the Variation Order comes into force or, if the original Experimental Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the date on which the variation or modification or the latest variation or modification comes into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent to Head of Highways and Infrastructure, Highways and Infrastructure Service, 5th Floor North Wing, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ or by email to trafficorders@brent.gov.uk, quoting reference TO/30/006A/NP.

7. Any person desiring to question the validity of the Variation Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within six weeks of the date on which the Variation Order was made, make application for the purpose to the High Court.
