THE ISLINGTON (PARKING PLACES) (CAR CLUBS) (NO. 1) EXPERIMENTAL TRAFFIC ORDER 2020

AND HIGHWAYS ACT 1980 - ROAD HUMP CHANGES

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Islington (‘the Council’) on 3 September 2020 made the above-mentioned Orders under sections 9, 10 and 124 of and Part IV of Schedule 9 to of the Road Traffic Regulation Act 1984, as amended.

2. The Council intends to provide a combination of mandatory and advisory with-flow cycle lanes on both sides of the carriageway (broken only at certain road junctions and where there are bus stops and pedestrian or cycle crossings and associated zig zag markings) much of which will be located against the kerb edge, with parking places ‘floated’ approximately 2 metres away from the kerb, in the following lengths of road:

(a) Liverpool Road, between Tolpuddle Street and Crossley Street;

(b) Penton Street, between White Lion Street and Tolpuddle Street; and

(c) Tolpuddle Street, throughout its length.

3. The general effect of the Orders will be, by way of an experiment:

(a) on the east side of Liverpool Road, to remove all parking places between Barford Street and Laycock Street, except for the following which will be repositioned approximately 2 metres closer to the centre of the carriageway, allowing cycle lanes referred to in paragraph 2 above to be placed between the edge of the parking places and the nearest kerb:

(i) residents parking places will be repositioned in the following lengths of road:

(A) outside No. 232 Liverpool Road to outside No. 258 Liverpool Road;

(B) opposite No. 343 Liverpool Road to opposite No. 353 Liverpool Road; and

(C) opposite Nos. 361 and 363 Liverpool Road;

(ii) the shared-use (residents permits and 2-hour pay and display) parking place will be repositioned in the length of road outside No. 344 Liverpool Road to 3 metres south-east of No. 477 Liverpool Road; and

(iii) the dedicated disabled persons parking places will be repositioned in the length of road opposite Nos. 357 and 359 Liverpool Road;

(iv) a new 6.5 metre dedicated disabled persons parking place will be positioned in the length of road opposite Nos. 361 and 363 Liverpool Road;

(b) on the west side of Liverpool Road:

(i) in the section between Richmond Avenue and Barnsbury Street:

(A) to remove the residents parking places and the pay and display parking place and provide the following:

(I) residents and business permit parking places in the following lengths of road: (1) partly outside No. 245 Liverpool Road to partly outside No. 259 Liverpool Road; and (2) party outside No. 261 Liverpool Road to outside No. 267 Liverpool Road; and

(II) a shared-use (residents and busines permits and 4-hour pay and display) parking place in the length of road partly outside No. 211 Liverpool Road to partly outside No. 243 Liverpool Road;

(ii) in the section between Cloudesley Place and Richmond Avenue and the section between Barnsbury Street and Crossley Street:

(A) to remove part of the residents permit parking places in the following lengths of road:

(I) outside Nos. 133 and 135 Liverpool Road;

(II) partly outside Nos. 143 Liverpool Road to partly outside No. 151 Liverpool Road;

(III) partly outside Nos. 189 Liverpool Road to partly outside No. 193 Liverpool Road;

(IV) outside No. 305 Liverpool Road;

(V) partly outside No. 315 and outside No. 317 Liverpool Road;

(VI) outside Nos. 337 and 339 Liverpool Road to partly outside No. 341 Liverpool Road; and

(VII) outside No. 371 Liverpool Road;

(B) to relocate the residents permit parking places, other than the lengths referred to in sub-paragraph (A) above and the car club parking places, approximately 2 metres closer to the centre of the carriageway allowing the cycle lanes referred to in paragraph 2 above to be placed between the edge of the parking places and the nearest kerb;

(C) to provide residents permit parking space outside Nos. 111 and 113 Liverpool Road;

(D) to remove the loading bay outside Nos. 383 to 385 Liverpool Road; and

(E) to provide a loading bay opposite Nos. 77 to 93 Liverpool Road, available to any vehicle whilst loading and unloading, that would operate between 8.30am and 6.30pm on Mondays to Fridays inclusive and between 8.30am and 1.30pm on Saturdays;

(c) in Penton Street, between White Lion Street and Chapel Market:

(i) to remove shared-use (residents and business and 2-hour pay and display) parking space outside part of Nos. 35/37 Penton Street; and

(ii) to relocate the parking places (other than the length referred to in paragraph (i) above) approximately 2 metres closer to the centre of the carriageway allowing cycle lanes referred to in paragraph 2 above to be placed between the edge of the parking places and the nearest kerb;

(d) to remove the bike hangar on the east side of Liverpool Road, opposite its junction with Barnsbury, Park and relocate it on the south side of Barnsbury Park near its junction with Liverpool Road; and

(e) to provide additional waiting and loading restrictions so that waiting and loading would be prohibited ‘at any time’ on both sides of the lengths of street referred to in paragraph 2 above, except as follows:

(i) where bus stops, taxi stands, loading bays and pedestrian or cycle crossings and associated zig zag markings are provided;

(ii) where parking places are located next to the kerb; and

(iii) on the west side of Liverpool Road, outside Nos. 243/245 and Nos. 259/261 Liverpool Road where the existing waiting and loading restrictions would continue to apply.

4. The Orders provide that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Service Director for Public Realm at the London Borough of Islington, or some person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Orders extends, modify or suspend any of the Orders or any provision thereof.

5. Any person who wishes to question the validity of the Orders, or of any provisions contained therein on the grounds that it or they are not within the relevant powers of the Road Traffic Regulation Act 1984 or that any requirement thereof or any relevant regulations made thereunder has not been complied with in relation to the Orders, may make application for the purpose to the High Court within six weeks from the date on which the Orders are made.

6. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46, 49 and 124 of and part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification comes into force. Any such objection must be in writing and must state the grounds on which it is made and be sent to Public Realm, 1 Cottage Road, London N7 8TP. Any objection may be communicated to, or be seen by, other persons who may be affected.

7. NOTICE IS ALSO HEREBY GIVEN that the Council proposes, under section 90A of the Highways Act 1980 to reposition or remove the type of road humps known as speed cushions so that they are not positioned within the cycle lanes referred to in paragraph 2 above above, as follows:

(a) remove speed cushions that are currently four abreast the carriageway and replace them with speed cushions of the same dimensions:

(i) three abreast the part of the carriageway that is bounded by cycle lanes referred to in paragraph 2 above above, in the following locations:

(A) Liverpool Road: (I) outside Nos. 70 to 72 Liverpool Road; (II) outside Nos. 119/121 Liverpool Road; (III) outside No. 214 Liverpool Road; (IV) outside No. 425 / No. 318 Liverpool Road; (V) approximately 5 metres north-west of No. 471 Liverpool Road; and (VI) outside No. 477 Liverpool Road; and

(B) Tolpuddle Street: (I) approximately 33 metres east of Penton Street;

(II) approximately 40 metres west of Cloudesley Street; and

(III) approximately 33 metres west of Liverpool Road;

(ii) two abreast the part of the carriageway that is bounded by the cycle lanes referred to in paragraph 2 above above, in the following locations: Liverpool Road: (I) outside Nos. 83 to 93 Liverpool Road; (II) outside Nos. 225/227 / No. 154 Liverpool Road; and (III) outside Nos. 257/259 Liverpool Road; and

(b) remove the speed cushion nearest the western kerb-line and the speed cushion nearest the eastern kerb-line, in the following locations: Liverpool Road: (A) outside No. 157 / No. 88 Liverpool Road; (B) outside No. 179 / No. 110 Liverpool Road; (C) outside Nos. 303/305 / Nos. 230/232 Liverpool Road; (D) outside No. 321 / No. 254 Liverpool Road; (E) outside and opposite No. 341 Liverpool Road; (F) outside and opposite No. 353 Liverpool Road; (G) outside and opposite No. 367 Liverpool Road; (H) outside and opposite No. 387 Liverpool Road; (I) outside Nos. 1 to 12 Starline Court / No. 302 Liverpool Road; and (J) outside and opposite No. 338 Liverpool Road.

8. Any person who wishes to object to or make other representations about the proposed road hump changes should send a statement in writing, specifying the grounds on which any objection is made, Public Realm, 1 Cottage Road, London N7 8TP (quoting reference Liverpool Road Speed Cushions), within the period of twenty-one days from the date on which this Notice is published. Any objection may be communicated to, or be seen by, other persons who may be affected.

9. A copy of the Orders, which will come into force on 11 September 2020, and of other documents including maps giving more detailed particulars of the Orders and road humps are available for inspection during normal office hours from the date of this Notice until the Orders cease to have effect at the following location:
