1. NOTICE IS HEREBY GIVEN that the London Borough of Merton, on 26 August 2020, made the above-mentioned Orders, under sections 9 and 10 of the Road Traffic Regulation Act 1984 (therein after referred to as the Act), and all other enabling powers.

2. The general effect of the “Botsford Road” Order will be to prohibit the right turn by vehicles from Botsford Road into Whatley Avenue.

3. The general effect of the “Seely Road” Orders will be to:

(a) introduce a point closure in Seely Road and prohibit vehicles, except pedal cycles, from entering that length of Seely Road which lies from a point 1.5 metres south-east of the south-eastern kerb-line of Hailsham Road south-eastward for a distance of 2 metres;

(b) apply in a modified form the provisions of the Merton (Waiting and Loading Restriction) Order 1977 so that waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited in

(i) Seely Road, the north-east side, from a point 6 metres north-west of a point opposite the south-eastern kerb-line of Hailsham Road south-eastward for a distance of 16.5 metres;

(ii) Seely Road, the south-west side, from the south-eastern kerb-line of Hailsham Road south-eastward for a distance of 10.5 metres; and

(c) remove any designated parking place in the lengths of Seely Road specified in sub-paragraph 3(b) above.

4. The general effect of the “Links Road” Orders will be to

(a) introduce a point closure in Links Road and prohibit vehicles, except pedal cycles, from entering that length of Links Road which lies from a point in line with the north-western boundary of No. 168 Links Road south-eastward for a distance of 2 metres;

(b) apply in a modified form the provisions of the Merton (Waiting and Loading Restriction) Order 1977 so that waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited in:

(i) Links Road, the north-east side, from its junction with Hailsham Road south-eastward for a distance of 13.5 metres.

(ii) Links Road, the south-west side, from a point 0.5 metres north-west of a point in line with the north-western building wall of No. 168 Links Road south-eastward for a distance of 9.5 metres.

(c) remove any designated parking place in the lengths of Links Road specified in sub-paragraph 4(b) above.

5. The general effect of the “Commonside East” Order will be to introduce a point closure in Commonside East and prohibit vehicles, except cycles, from entering that length of Commonside East which lies from a point 2 metres south-east of the south-eastern kerb-line of Spencer Road south-eastward for a distance of 2 metres.

6. The general effect of the “Sandy Lane” Orders will be to

(a) introduce a point closure in Sandy Lane and prohibit vehicles, except pedal cycles, from entering that length of Sandy Lane which lies between a point 10 metres north-west of the north-western kerb-line of Fernlea Road and a point 12 metres north-west of the said kerb-line;

(b) apply in a modified form the provisions of the Merton (Waiting and Loading Restriction) Order 1977 so that waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited in Sandy Lane the south-west side, from a point 4.5 metres north-west of the north-western kerb-line of Fernlea Road north-westward for a distance of 15 metres.

7. The Orders have provided that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Council’s Head of futureMerton or some person authorised in that behalf by him may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic, or for preserving or improving the amenities of the area through which any road affected by the Orders runs, modify or suspend the Orders or any provision thereof.

8. A copy of the Orders, which will come into operation on 7 September 2020 and can continue in force for up to 18 months, of plans of the relevant areas and of the Council’s statement of reasons for making the Orders can be inspected on-line at: https://www.merton.gov.uk/covid-19-transport-projects or during normal office hours on Mondays to Fridays inclusive at: Merton Link, Merton Civic Centre, London Road, Morden, SM4 5DX, until the Orders cease to have effect.

9. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.

10. The Council of the London Borough of Merton will consider in due course whether the provisions of the Orders should be reproduced and continued in force indefinitely by means of Orders made under the Road Traffic Regulation Act 1984. Persons desiring to object to the making of the Orders under the said Act of 1984 for the purpose of such reproduction and continuation in force may, within a period of 6 months beginning with the day on which the experimental Orders came into force, or if an experimental Order is varied by another Order or modified pursuant to section 10(2) of the said Act of 1984, within a period of 6 months beginning with the date on which the variation or modification or the latest variation or modification came into force, may visit https://www.merton.gov.uk/streets-parking-transport/covic-19-transport-projects and do so, or send a statement in writing of their objection and the grounds thereof to the Head of futureMerton, Environment and Regeneration, Merton Civic Centre, London Road, Morden, SM4 5DX quoting reference: LTN-Botsford Road, LTN-Commonside East, LTN-Links Road, LTN-Sandy Lane or LTN-Seely Road as applicable.
