PORTOBELLO ROAD – EXPERIMENTAL PEDESTRIAN AND CYCLE ZONE APPLYING ON MONDAYS TO SATURDAYS BETWEEN 10AM AND 4PM

THE KENSINGTON AND CHELSEA (PRESCRIBED ROUTES) (NO. 6) EXPERIMENTAL TRAFFIC ORDER 2020

1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kensington and Chelsea on 28th May 2020 made the above-mentioned Order under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended. The Order will come into force for the purposes of the provisions referred to in paragraph 2(b) of this Notice on 12th June 2020 and for all other purposes on 8th June 2020 and will continue in force for up to 18 months.

2. The general effect of the Order will be to:

(a) prohibit all vehicles, other than pedal cycles, from proceeding northwards in Portobello Road at the points referred to in the Schedule to this Notice, between 10 a.m. and 4 p.m. on Mondays to Thursdays inclusive. Note: The restrictions will not apply to vehicles requiring access to properties in Portobello Road situated between Westbourne Grove and Cambridge Gardens or in any side road that can only be accessed via that length of road; and

(b) exempt pedal cycles from the no entry restrictions at the points in Portobello Road referred to in paragraph (a) above that currently apply on Fridays and Saturdays.

3. The Order provides that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Director for Transport and Highways at the Council of the Royal Borough of Kensington and Chelsea, or some person authorised by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order extends, modify or suspend the Order or any provision thereof.

5. A copy of the Order and other documents giving more detailed particulars of the Order can be inspected at Council Offices, 37 Pembroke Road, London W8 6PW during normal office hours on Mondays to Fridays inclusive or may be obtained via email by contacting trafficorders@rbkc.gov.uk.

6. The Council will be considering in due course whether the provisions of the Order should be continued indefinitely by means of an Order made under section 6 of the Road Traffic Regulation Act 1984. Any person may object to the making of this Order for the purpose of such indefinite continuation within a period of six months beginning with the day on which the Order comes into operation, or, if the Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into operation. Any such objection must be in writing and must state the grounds on which it is made and be sent to Traffic Orders, Room 308, Council Offices, The Royal Borough of Kensington and Chelsea, 37 Pembroke Road, London, W8 6PW or email: trafficorders@rbkc.gov.uk, quoting reference RBKC/TMO/Portobello Road ETO by 12th December 2020.

7. Under the Local Government (Access to Information) Act 1985, any letter you write in response to this Notice may be made available to the press and to the public, who would be entitled to take copies of it if they so wished.

8. Anyone wishing to question the validity of the Order or of any of its provisions on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Order was made, apply for the purpose to the High Court.
