HEALTHY SCHOOL STREETS – WEST HAM C OF E PRIMARY SCHOOL AND LATHOM JUNIOR SCHOOL

THE NEWHAM (PEDESTRIAN AND CYCLE ZONE) (NO. 3) EXPERIMENTAL TRAFFIC ORDER 2019

THE NEWHAM (PEDESTRIAN AND CYCLE ZONES) (NO. 4) EXPERIMENTAL TRAFFIC ORDER 2019

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Newham on 11 November 2019 made the above-mentioned Orders under Section 9 of the Road Traffic Regulation Act 1984, as amended.

2. The effect of the Orders will be to introduce part-time pedestrian and cycle zones, in the vicinity of schools, where access by vehicles will be prohibited as follows:

(a) West Ham C of E Primary School – pedestrian and cycle zone will be in force in St Lucia Drive from 8.30 to 9.30am and from 3 to 4pm on Monday to Friday during school term-time; and

(b) Lathom Junior School - pedestrian and cycle zones will be in force in (i) Keppel Road, between Clements Road and Lathom Road; and (ii) Lathom Road, between High Street North and Keppel Road. The zones will be in force from 8 to 9am and from 3 to 4pm on Monday to Friday during school term-time.

3. Exemptions will apply to:

(a) pedal cycles;

(b) virtual access permit holders;

(c) vehicles displaying a valid Disabled (Blue) Badge;

(d) refuse collection vehicles;

(e) vehicles being used: (i) for ambulance, fire brigade or police purposes; (ii) in connection with the removal of an obstruction; (iii) in connection with the cleansing, maintenance, improvement or reconstruction of the carriageway; (iv) in connection with the placing, maintenance, improvement, reconstruction or removal of street furniture; (v) for the purpose of any building operation or demolition; or in connection with the laying, erection, alteration or repair of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any communications network; or (vi) for the provision of a universal postal service.

4. Virtual (electronic) access permits will be granted without charge to those occupiers who keep vehicles at addresses specified in the Schedule to this Notice.

5. The Orders, which will come into force on 2 December 2019, and other documents giving more detailed particulars of the Orders can be inspected during normal office hours on Monday to Friday inclusive at Newham Dockside, 1000 Dockside Road, London E16 2QU until such time as the Orders cease to have effect.

7. If any person wishes to question the validity of either of the Orders or of any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984 or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within six weeks from the date on which the Order is made, apply for the purpose to the High Court.

8. If the provisions of the Orders continue in force for a period of not less than six months, the Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of Orders under Section 6 of the said Act of 1984.

9. Within a period of six months –

(a) beginning with the day on which the experimental Orders came into force; or

(b) if either Order is varied by another Order or modified pursuant to Section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force

any person may object to the making of Orders for the purpose of such indefinite continuation.

10. All objections and other representations relating to the continuation of the Orders must be made in writing. All objections must specify the grounds on which they are made. They should be sent to the Assistant Director, Highways and Sustainable Transport, London Borough of Newham, 3rd Floor West, Newham Dockside, 1000 Dockside Road, London E16 2QU or by email, quoting the Order title, to: traffic.orders@newham.gov.uk

11. Under the requirements of current access to information legislation, any letter or e-mail sent to the Council in response to this Notice may be subject to publication or disclosure, or both, including communication to other persons affected.
