THE MERTON (PRESCRIBED ROUTE) (COMMONSIDE EAST, ESHER ROAD AND HALLOWELL CLOSE) EXPERIMENTAL TRAFFIC ORDER 2019

1. NOTICE IS HEREBY GIVEN that the London Borough of Merton, on 21 August 2019, made the above mentioned Orders under sections 9 and 10 of the Road Traffic Regulation Act 1984 (therein after referred to as the Act), and all other enabling powers.

2. The general effect of the Orders will be to prohibit any motorised vehicle entering the roads listed in the Schedule to this notice, during the corresponding periods specified, with an exemption for those authorised vehicles which are specified on a white list for each road, held and maintained by the Council.

3. The Orders have provided that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Council’s Head of futureMerton or some person authorised in that behalf by him may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic, or for preserving or improving the amenities of the area through which any road affected by the Orders run, modify or suspend the Orders or any provision thereof.

4. A copy of the Orders, which will come into operation on 2 September 2019, of plans of the relevant areas and of the Council’s statement of reasons for making the Orders can be inspected during normal office hours on Mondays to Fridays inclusive, until the Orders cease to have effect, at: Merton Link, Merton Civic Centre, London Road, Morden, SM4 5DX.

5. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.

6. The Council of the London Borough of Merton will consider in due course whether the provisions of the Orders should be reproduced and continued in force indefinitely by means of Orders made under section 6 of the Road Traffic Regulation Act 1984. Persons desiring to object to the making of the Orders under section 6 of the said Act of 1984 for the purpose of such reproduction and continuation in force may, within a period of 6 months beginning with the day on which the experimental Orders came into force, or if an experimental Order is varied by another Order or modified pursuant to section 10(2) of the said Act of 1984, within a period of 6 months beginning with the date on which the variation or modification or the latest variation or modification came into force, send a statement in writing of their objection and the grounds thereof to the Head of futureMerton, Environment and Regeneration, Merton Civic Centre, London Road, Morden, SM4 5DX quoting references:- ES/Harris-Ivy-Gdns in regards to the ‘Ivy Gardens’ Order, ES/Links-Frinton-Gunton in regards to the ‘Frinton Road and Gunton Road’ Order and ES/St Thomas of Canterbury-Commonside East in regards to the ‘Commonside East, Esher Road and Hallowell Close’ Order.
