M1 J13-16 SMART MOTORWAY

ENVIRONMENTAL IMPACT ASSESSMENT

DETERMINATION UNDER SECTION 105AB (1)(B) OF THE HIGHWAYS ACT 1980 (AS AMENDED)

Highways England gives notice that it has been determined that the M1 J13-16 Smart Motorway proposal which is a relevant project within the meaning of section 105ZA (2) of the Highways Act 1980 (as amended) is not subject to environmental impact assessment in accordance with Part 105A of the Highways Act 1980 (as amended). This is due to the fact that there are no likely significant effects on the environment when taking into account the characteristics and location of the development, and the type and characteristics of the potential impacts. This conclusion has taken into account measures to avoid or prevent significant adverse effects on the environment. Measures include the application for and compliance with protected species licenses; installation of approximately 4.5km of noise barrier and application of low noise surfacing in Lanes 1 and 4; provision of replacement landscape mitigation and habitat planting along the route; avoidance of floodplain encroachment (or providing compensation where not possible) in areas of flood zone; and the presence of a Construction Environmental Management Plan (CEMP). The CEMP will regulate the implementation of defined control measures during construction, including the specific management of construction noise and vibration at certain sensitive locations.
