NOTICE OF DISCLAIMER OF BONA VACANTIA
WHEREAS it has been represented to me, the Queen’s and Lord Treasurer’s Remembrancer, that the following subjects forming part of the roadway and pavement lying adjacent to the Harbour at Kirkcudbright may have fallen to the Crown as bona vacantia: (1) an area of ground extending to 201 square metres being the subjects shown outlined in red and hatched in black on the plan annexed as relative hereto and (2) an area of ground extending to 197 square metres shown outlined in red on the said plan: Now THEREFORE I, DAVID BRYCE HARVIE, the Queen’s and Lord Treasurer’s Remembrancer, in exercise of my discretion as the Crown’s representative in Scotland in respect of any bona vacantia arising at common law, DO BY THIS NOTICE WAIVE AND DISCLAIM the Crown’s whole right and title (if any) in and to the aforesaid heritable properties arising at common law.
