TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State gives notice of an Order made under Section 247 of the above Act entitled "The Stopping up of Highway (West Midlands) (No.53) Order 2017" authorising the stopping up of the whole of the unnamed footpath which commences from its junction with Ventnor Avenue and lies between the electricity substation and the northern boundary of the former Wheeler Tavern at Newtown, Birmingham, in the City of Birmingham to enable development as permitted by Birmingham City Council, under reference 2017/07183/PA.

Copies of the Order may be obtained, free of charge, from the Secretary of State, National Transport Casework Team, Tyneside House, Skinnerburn Road, Newcastle Business Park, Newcastle upon Tyne NE4 7AR or nationalcasework@dft.gsi.gov.uk (quoting NATTRAN/WM/S247/3073) and may be inspected during normal opening hours at Birmingham City Council, Planning and Regeneration, 1 Lancaster Circus, Lancaster Circus Queensway, Birmingham B4 7DJ.

Any person aggrieved by or desiring to question the validity of or any provision within the Order, on the grounds that it is not within the powers of the above Act or that any requirement or regulation made has not been complied with, may, within 6 weeks of 11 January 2018 apply to the High Court for the suspension or quashing of the Order or of any provision included.
