THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 452) ORDER 2015
1.NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 24 August 2015 made the above mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part I of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
2. The general effect of the ‘Parking Place Amendment’ Order will be to make minor drafting amendments relating to the existing pay and display parking places in:—
(a) Harrow Road, Kensal Green, the north-east side, from a point 9.00 metres north-west of the north-western kerb-line of Victor Road north-westward for a distance of 16.00 metres;
(b) Harrow Road, Kensal Green, the north-east side, from a point 12.00 metres south-east of a point opposite the party wall of Nos. 1096 and 1098 Harrow Road, south-eastward for a distance of 56.30 metres.
3. The general effect of the ‘Goods Vehicles Free Loading Places’ Order will be to:-
(a) designate free loading places in the lengths of streets specified in Schedule 1 to this Notice to operate between 8.30 a.m. and 6.30.p.m. Mondays to Fridays inclusive (loading/unloading limited to 1 hour with no return for 1 hour);
(b) specify that goods carrying vehicles constructed or adapted for use for the carriage of goods or burden of any description and is not drawing a trailer, may be used, subject to the provisions of the Order, for the purpose of continuous loading and unloading during the permitted hours.
4. The general effect of the ‘Waiting and Loading Restriction’ Order will be to further amend the Brent (Waiting and Loading Restriction) Order 1979, so that:-
(a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 2 to this Notice;
(b) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.00 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive in the lengths of streets specified in Schedule 3 to this Notice;
(c) waiting by vehicles (for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 4 to this Notice;
(d) waiting by vehicles (for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.00 a.m. and 9.30 a.m. and between 4.30 p.m. and 6.30 p.m. on Mondays to Saturdays inclusive in the lengths of streets specified in Schedule 5 to this Notice;
(e) waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 40 minutes in the same place will be prohibited throughout the week in the lengths of streets specified in Schedule 2 to this Notice and between 8.00 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive in lengths of streets specified in Schedule 3 to this Notice;
(f) the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of streets specified in Schedules 2, 3, 4 and 5) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
(g) the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited in the lengths of streets specified in Schedules 2, 3, 4 and 5;
(h) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 2, 3, 4 and 5 to this Notice will be revoked.
The prohibitions referred to in sub-paragraphs 4(a) to (e) inclusive above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
6. A copy of the Orders, which will come into operation on 7 September 2015, of a map of the relevant area and of the relevant Orders of 1979 and 2007 (and of any Orders which have amended those Orders) can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ.
7. Copies of the Orders may be purchased from the address mentioned in paragraph 6 above.
8. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

Harrow Road, Kensal Green, the north-east side, from a point opposite the party wall of Nos. 1096 and 1098 Harrow Road south-eastward for a distance of 14.00 metres.
Victor Road, the south-east side, from a point 7.00 metres north-east of the north-eastern kerb-line of Harrow Road, Kensal Green north-eastward for a distance of 10.00 metres.
