In accordance with Section 359 of the Insolvency Act 2011, I, Mark Mordejay Benady of Benady Cohen & Co, 21 Engineer Lane, Gibraltar, give notice that I was appointed Trustee in Bankruptcy by Court Order dated 18 May 2015 .

All persons having in their possession any of the effects of the Bankrupt must deliver them to me, and all debts due to the Bankrupt must be paid to me.

Creditors who have not yet proved their debts must forward their proofs of debt to me.

Notice is given that a meeting of creditors has been summoned by the Trustee under Section 366 of the Insolvency Act 2011 to be held at the office of Benady Cohen & Co, 21 Engineer Lane, Gibraltar on 29 June 2015 at 11:00 am for the purposes of considering whether a creditors’ committee should be formed. In the event that a creditors’ committee is not formed, pursuant to Section 466(2) it is proposed that the basis of the Trustee’s remuneration be fixed by reference to the time properly given by the Trustee and his staff in attending to matters arising in the Bankruptcy to be drawn on account during the course of the Bankruptcy.

Please note that further to Section 366(3) a creditors meeting may be requisitioned in accordance with the Rules by 25 per cent in value of the creditors of the bankrupt.

A form of proxy, available from the offices of Benady Cohen & Co must be lodged with me not later than 12 noon on the business day immediately preceding the meeting to entitle you to vote by proxy, together with a completed proof of debt form, if you have not already lodged one.
