PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990, SECTIONS 69 AND 70
DESIGNATION OF COBBS CORNER CONSERVATION AREA, LONDON SE26

This notice is given pursuant to section 70 of the above Act. On 7 September 2007 the Council has determined that the area described in the Schedule below (“the Conservation Area”) is an area of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance. The Council has therefore designated that area a conservation area to be known as the Cobbs Corner Conservation Area, London SE26.

The effect of including the designation of the Cobbs Corner Conservation Area (“the Conservation Area”) is as follows:

1. Conservation area consent will now be required before the demolition of any unlisted buildings located in the Conservation Area (other than excepted buildings) can take place.

2. Planning applications for development in the Conservation Area, which would, in the Council’s opinion affect the character or appearance of the Conservation Area, must be given publicity. Representations received as a result of that publicity must be taken into account in determining those applications.

3. Any person exercising any functions, under or by virtue of certain legislation (the Planning Acts, the Historic Buildings and Ancient Monuments Act 1953, and sections 70 and 73 of the Leasehold Reform, Housing and Urban Development Act, 1993) in respect of land in the Conservation Area, is under a duty to pay special attention to the desirability of preserving or enhancing the area’s historic character or appearance.

4. It is an offence, subject to certain exceptions, to cut down, top, lop, uproot, wilfully damage or wilfully destroy any tree in the Conservation Area except with the prior written consent of the Council.

5. The Council is now under a duty to formulate and publish proposals for the preservation and enhancement of the Conservation Area.

6. Permitted development rights for development in the Conservation Area are more restricted than before (persons wishing to exercise those rights within the Conservation Area should first check the extent to which they may do so with the Council’s Planning Department).

7. The display of certain types of advertisement including new illuminated advertisements (Class 4A and 4B), flag advertisements on sites where authorised residential development is being carried out (Class 7B), new advertisement hoardings enclosing sites where authorised development is being carried or is about to be carried out (Class 8), advertisement consisting of balloons not more than 60 metres above ground level (Class 15) advertisements on telephone kiosks (Class 16) of Schedule 3 to the Town & Country Planning (Control of Advertisements) Regulations 2007 (SI 2007 No 783) in the Conservation Area will require express advertisement consent. Advertisements displayed prior to the date of designation of the conservation area under Class 4a, 4b,8 are subject to the time limits prescribed for their continued display under the respective Class.

8. Specific statutory duties are imposed on telecommunications operators.

A map showing the full extent of the Cobbs Corner Conservation Area may be inspected, free of charge, during normal office hours at the council’s offices located at Directorate of Regeneration, Planning Service, Laurence House, 1 Catford Road, Catford, London SE6 4RU.
