THE CROYDON (EAST INNER) (PARKING PLACES) (NO 1) ORDER 2002 (AMENDMENT NO 1) TRAFFIC ORDER 2005
1. Notice is hereby given that Croydon Council on 31 October 2005 made Traffic Orders under the relevant sections of the Road Traffic Regulation Act, 1984 as amended, and the Road Traffic Act 1991. 2. The general effect of the Croydon (On Street Parking Places) (Limited Time) (No 1) Traffic Order 2005 would be to make permanent the measures specified below, which were introduced on an experimental basis: (a) to provide ‘pay and display’ parking bays so that they operate between the hours of 9.00 am and 5.00 pm on Mondays to Saturday inclusive in the lengths of Brighton Road, South Croydon specified in Schedule 1 to this notice; (b) to limit the maximum period for waiting in a parking place to 1 hour; (c) to provide that the charge for leaving a vehicle vary from 20p for fifteen minutes up to 80p (maximum) for 1 hour (maximum) with no return within two hours. 3. The general effect of the Croydon (Prohibition of Stopping on Cab Ranks) (No 3) Traffic Order 2005 would be to make permanent the measures specified below, which were introduced on an experimental basis: (a) to designate new cab ranks for use by hackney carriages in those lengths of Cherry Orchard Road specified in Schedule 2 to this notice to operate At any time throughout the week and revoke the “pay and display” parking bays that were situated in those specified lengths of Cherry Orchard Road; (b) to provide that Council parking attendants may issue a penalty charge notice where they have reason to believe that a vehicle, other than a hackney carriage, has been left or been permitted to wait in a cab rank during the prescribed hours; (c) to provide that the penalty charge will be payable to the Council within 28 days, reduced by 50% on early settlement of the payment within 14 days for an offence committed in a designated parking place. 4. The Order will further provide that where a parking attendant has reason to believe that a vehicle, other than a hackney carriage, has been left or permitted to wait in a cab rank during the prescribed hours, he or another person acting under his direction, may fix an immobilisation device to the vehicle or may remove or cause to be removed the vehicle from the said street or parking place to a safe place of custody, until payment has been received of such charges the Council may be entitled to recover from the person responsible for release of the immobilisation device or for the removal, storage and disposal of the vehicle, in accordance with the provisions of the Road Traffic Act 1991. 5. Copies of the Orders which will come into operation on 7 November 2005 can be inspected during normal office hours on Monday to Fridays inclusive, until the end of 6 weeks from the date on which the Order was made at the Enquiry Counter, “One Stop” Facility, Taberner House, Park Lane, Croydon, Surrey. 6. Copies of the Orders may be obtained from the Order Making section, Parking and Departmental Support Services, 1st Floor, Davis House, Robert Street, Croydon, CR0 1QQ. 7. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder have not been complied with in relation to the Orders may, within 6 weeks of the date on which the Orders were made, make application for the purpose to the High Court.
