NOTICE OF APPLICATION

STOPPING-UP AND DIVERSION OF HIGHWAY ADJACENT TO WITAN GATE AND AVEBURY BOULEVARD CENTRAL MILTON KEYNES, STOPPING-UP ORDER 2005

Take notice that the Council of the Borough of Milton Keynes (“the Council”), which is the Local Highway Authority for the purposes of the Highways Act 1980 (“the Act”) for the area in which highway adjacent to Witan Gate and Avebury Boulevard Order 2005 is situated, intends to apply to the Magistrates Court sitting at Milton Keynes Magistrates’ Court, 301 Silbury Boulevard, Witan Gate East, Milton Keynes, MK9 2AJ, on Friday 29 April 2005 at 10.30 am for an Order under section 116 of the Act (“the Order”), authorising the Council to stop up parts of the highway and provide suitable diversion routes adjacent to Witan Gate and Avebury Boulevard as shown on the plans to which the Order relates (“Plan 1” and “Plan 2” respectively) and described in the Schedule below on the grounds that the said parts of the highway will be diverted to provide a nearer or more commodious alternative at ground level. At the hearing of the application for the Order, any person who would be aggrieved by the making of the Order applied for will have the right to be heard. A copy of the Plans showing the areas of the highway to be stopped-up and diverted can be inspected, free of charge, at the offices of the Council at the Civic Offices, 1 Saxon Gate, East Milton Keynes MK9 3AG between 9.30 am and 4.30 pm on Mondays to Fridays inclusive. Area B	An area of land measuring approximately 585.8 square metres in area located to the south of Avebury Boulevard, Milton Keynes.
Area C	An area of land measuring approximately 579.9 square metres in area located to the north of Avebury Boulevard, Milton Keynes.
Area D	An area of land measuring approximately 178.5 square metres in area having a width of 7 metres and length of 24.4 metres located under Avebury Boulevard, Milton Keynes.
Area E	An area of land measuring approximately 185.2 square metres in area having a width of 7.3 metres and length of 25.4 metres located under Avebury Boulevard, Milton Keynes.
Area F	An area of land measuring approximately 80.2 square metres in area having a width of 5 metres and length of 16.2 metres located south of Avebury Boulevard, Milton Keynes.
Area G	An area of land measuring approximately 348.9 square metres in area having a width of 4.2 metres and length of 84.3 metres located south of Avebury Boulevard, Milton Keynes.
Area H	An area of land measuring approximately 128.3 square metres in area having a width of 7.1 metres and length of 18.3 metres located under Witan Gate, Milton Keynes.
Area I	An area of land measuring approximately 127.5 square metres in area having a width of 7 metres and length of 18.3 metres located under Witan Gate, Milton Keynes.
Area J	An area of land measuring approximately 49.9 square metres in area having a width of 1 metre and length of 49.9 metres located south of Avebury Boulevard, Milton Keynes.
Area K	An area of land measuring approximately 170.8 square metres in area having a width of 1 metre and length of 170.2 metres located south of Avebury Boulevard, Milton Keynes.
