THE BARNET (WAITING AND LOADING RESTRICTION) SPECIAL PARKING AREA) (EXPERIMENTAL) (AMENDMENT) (NO 85) TRAFFIC ORDER 2004

Notice is hereby given that the Council of the London Borough of Barnet, on 22 July 2004, made the above Orders (“the Orders”) under section 9 of the Road Traffic Regulation Act 1984 and all other enabling powers. Currently the East Finchley Controlled Parking Zone operates between 2.00 pm and 3.00 pm, Mondays to Fridays. However due to the temporary relocation of the Hampstead Garden Suburb Institute to Park House, the Council deems it necessary to increase the operational period of the restrictions on certain roads wihin the East Finchley Controlled Parking Zone to ensure that permit holders’ on-street parking facilities are protected. The general effect of the Orders will be to increase the parking restrictions so they operate between 10.00 am and 6.30 pm, Mondays to Saturdays on the roads or lengths of roads detailed in the attached Schedule 1 to this notice The On-Street Parking Places Order: 1. provides residents parking bays operating between 10.00 am and 6.30 pm, Mondays to Saturdays. These bays are for use by vehicles displaying a valid residents or visitor permit, or blue disabled persons badge. Disabled motorists and motorcyclists do not need to display a permit in the residents bays; 2. provides general permit parking bays operating between 10.00 am and 6.30 pm, Mondays to Saturdays. These bays are for use by vehicles displaying a valid residents, business or visitor permit, or blue disabled persons badge. Disabled motorists and motorcyclists do not need to display a permit in general permit bays; 3. converts all Free parking bays in the areas detailed in Schedule 1 to this notice to General Permit bays operative between 10.00 and 6.00 pm, Mondays to Saturdays. These bays are for use by vehicles displaying a valid residents, business or visitor permit, or blue disabled persons badge. Disabled motorists and motorcyclists do not need to display a permit in the general permit bays. The Waiting and Loading Order will amend various existing yellow line waiting restrictions in the roads or lengths of roads detailed in the attached Schedule, where parking bays are not provided. Charges for residents permits are £35 for the first permit, £65 for a second and £90 for a third permit. Permits are limited to one per resident, to a maximum of 3 per household. The permits are valid for 1 year. Visitor permits, which can be purchased by residents, cost £5 for a book of 10 permits. Disabled badge holders and motorcyclists are exempt from permit charges. Business permits are £150 each to a maximum of 3 per business. The Orders provide that, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Chief Executive of the Council or some person authorised in that behalf by him, may, if it appears to him essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Orders run, modify or suspend the operation of the Orders or any provision thereof. Copies of the Orders, which will come into operation on Monday 2 August 2004, a plan of the scheme, the Council’s statements of reasons for making the Orders and for proceeding by way of experiment can be inspected on Mondays to Fridays inclusive between 9.00 am and 5.00 pm (Bank Holidays excepted) at: (a) Parking Design Team, Building 4, North London Business Park, Oakleigh Road South, London N11 1NP (b) 1st Contact, The Town Hall, The Burroughs, Hendon, London NW4 4BG. Further details may be obtained by contacting the Parking Design Team on 0208 359 7545. Any person wishing to question the validity of the Orders or of any of their provisions on the grounds that they are not within the powers of the Road Traffic Regulation Act 1984 or that any of the requirements thereof or of any relevant regulations made thereunder have not been complied with in relation to the Orders may, within 6 weeks from the date on which the Orders were made, make application for the purpose to the High Court. If the provisions of the Orders continue in operation for a period of not less than 6 months, the Council will consider in due course whether the provisions of the Orders should be reproduced and continued in force indefinitely by means of Orders under section 6 of the said Act of 1984. Anyone who wishes to object to the making of such Orders for the purpose of such reproduction and continuation in force may, within the period of 6 months from the date on which the Orders were made, send a statement in writing of their objection and the grounds thereof to the Head of Highways and Design, Building 4, North London Business Park, Oakleigh Road South, London N11 1NP.
