THE LONDON BOROUGH OF MERTON (CONTROLLED ZONES) (PARKING PLACES) (W5 AND 5F) EXPERIMENTAL ORDER 2003
CONTROLLED PARKING ZONES 5F AND W5

1. Notice is hereby given that the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, have made the above-mentioned Order under section 9 and Part IV of, Schedule 9 of the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985 and the Road Traffic Act 1991. The Order was made on 17 December 2003 and shall become operational on 5 January 2004 and shall continue in force for a maximum period of 18 months. 2. The general effects of the Order will be: (a) to enable the residents permits issued in respect of W5 and 5F to be interchangeable during the prescribed hours of each zone; (b) to introduce additional permit holder bays in Fairlawn Road, Dundonald Road and Newton Road; (c) to convert the existing meter bays in Caroline Road, Cochrane Road and Goodenough Road to permit holder bays; (d) to convert the existing permit holder bays on the south-eastern side of Dundonald Road to shared use bays operating Monday to Saturday 8.30 am to 6.30 pm costing 30 pence per hour maximum stay 10 hours; (e) to introduce pay and display bays on the south-east side of Dundonald Road from a point opposite the common boundary of No 32-34 Dundonald Road south-westwards for a distance of 18 metres operating Monday to Saturday between 8.30 am and 6.30 pm, 30 pence per hour, maximum stay 2 hours; (f) to convert a number of the existing permit holder bays on the north western side of Avebury Road to shared use bays operating Monday to Friday between 8.30 am and 6.30 pm, 30 pence per hour, maximum stay 5 hours; (g) to convert the free parking bays on Merton Hall Road to pay at meter bays, operating Monday to Friday 8.30 am to 6.30 pm, 30 pence per hour, maximum stay 1 hour; (h) to convert the existing pay and display bays on Avebury Road and Dundonald Road to shared use bays operating Monday to Friday between 8.30 am and 6.30 pm, 30 pence per hour, maximum stay 10 hours; (i) to convert the existing pay and display bays in Merton Hall Road to shared use bays operating Monday to Friday between 8.30 am and 6.30 pm, 30 pence per hour, maximum stay 10 hours; (j) to introduce an annual visitors’ permit, the terms of which are that a maximum of one shall be made available per household, on application, in any twelve months, and the cost shall be £100 (one hundred pounds). 3. Nothing in Article 2 of this notice shall apply: (a) to anything done with the permission or at the direction of a police constable in uniform; (b) in relation to a vehicle being used for ambulance, fire brigade or police purposes; 4. While the Order remains in force, the Director of Environment and Regeneration or some person authorised in that behalf by him, may, amongst other things under section 10(2) of the Act, if it appears to him or that person, essential in the interest of convenient, expeditious, and the safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the Order or provisions thereof. 5. A copy of the proposed Order, a plan identifying the area affected by the proposed Order, and the Council’s statement of reasons for making the Order can be inspected during normal office hours on Mondays to Fridays inclusive at the London Borough of Merton, Merton Link, Merton Civic Centre, London Road, Morden, Surrey, until the end of a period 6 months from the date on which the Order was commenced. 6. The London Borough of Merton as the Order making authority will consider in due course whether the provisions of the Order should be continued in force indefinitely by means of Order made under section 6 of the Act. Any person desiring to object to the provisions of the Order continuing indefinitely may, within the above-mentioned period of 6 months, send a statement in writing of their objection and providing the grounds on which it is made to the Director of Environment and Regeneration at the address below quoting Ref ES/SGE. 7. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Act, or that any of the relevant requirements of the Act, or of any relevant regulations made under that Act have not been complied with in relation to the Order may, within 6 weeks from the date on which the Order was made, make an application for the purpose to the High Court.
