TOWN AND COUNTRY PLANNING ACT 1990
HIGHWAY AND FOOTPATHS AT PADGATE CLOSE, CASTLE VALE, BIRMINGHAM
The Secretary of State hereby gives notice that he has made an Order, under section
247 of the above Act, entitled “The Stopping-up of Highways (City of Birmingham) (No
10) Order 2003”, authorising the stopping-up of highway at Padgate Close, Castle Vale,
Birmingham and requiring the provision of new highways shown as stippled on the deposited
plan and the improvement of existing highways shown as cross-hatched on the deposited
plan.
The Order as made, will authorise the stopping-up only to enable the development
described in the Schedule to this notice to be carried out in accordance with the
planning permission granted by Birmingham City Council on 21 November 2002, under
Ref N/01434/02/FUL.
Copies of this Order may be obtained, free of charge, on application to the Government
Office for the West Midlands at the offices of the Director, South Eastern Division,
77 Paradise Circus, Queensway, Birmingham B1 2DT (quoting Ref 5104/35/1/199) and may
be inspected at all reasonable hours at Castle Vale HAT, 220 Farnborough Road, Castle
Vale B35 7NL. Any person aggrieved by the Order and desiring to question the validity
thereof, or of any provision contained therein, on the grounds that it is not within
the powers of the above Act or that any requirement of that Act or of any regulation
made thereunder has not been complied with in relation to the Order may, within 6
weeks of 29 August 2003, apply to the High Court for the suspension or quashing of
the Order or of any provisions contained therein.
