THE NEWHAM (PEDESTRIAN AND CYCLE ZONE) (NO. 5) TRAFFIC ORDER 2022

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Newham on 4 July 2022 made the above-mentioned Orders under Sections 6 and 124 of the Road Traffic Regulation Act 1984, as amended.

2. The effect of the Orders will be to continue in force indefinitely the provisions of the Newham (Pedestrian and Cycle Zone) (No. 1) Experimental Traffic Order 2021; the Newham (Pedestrian and Cycle Zones) (No. 2) Experimental Traffic Order 2021; the Newham (Pedestrian and Cycle Zone) (No. 3) Experimental Traffic Order 2021; the Newham (Pedestrian and Cycle Zone) (No. 4) Experimental Traffic Order 2021 and the Newham (Pedestrian and Cycle Zone) (No. 5) Experimental Traffic Order 2021.

3. The above experimental Orders introduced part-time pedestrian and cycle zones, in the vicinity of schools, where access by vehicles is prohibited as follows:

(a) Sheringham Nursery School and Sheringham Primary School – pedestrian and cycle zone (H6) is in force in Sheringham Avenue (between Romford Road and Wolferton Road) from 8.30 to 9.30am and from 2.45 to 3.45pm on Monday to Friday during school term-time;

(b) Park Primary School - pedestrian and cycle zone (H7) is in force in Bolton Road, Dyson Road, Eleanor Road, Fairland Road (between Vaughan Road and Vicarage Road), Faraday Road, Ham Park Road (between Fairland Road and Warwick Road E15), Mathews Park Avenue, Townley Court and Vaughan Road from 8.30 to 9.30am and from 2.30 to 4pm on Monday to Friday during school term-time;

(c) Hartley Primary School - pedestrian and cycle zone (H8) is in force in Campbell Road E6, Hartley Avenue, Wakefield Street (between Aintree Avenue and Winter Avenue) and Winter Avenue from 8.30 to 9.30am and from 2.30 to 3.30pm on Monday to Friday during school term-time;

(d) Brampton Primary School - pedestrian and cycle zone (H9) is in force in Boston Road, Brampton Road (between Denbigh Road and Haldane Road), Chesley Gardens (between Masterman Road and Haldane Road), Frinton Road (between Beverley Road and Brampton Road), Lichfield Road (between Brampton Road and Hatherley Gardens) and Masterman Road (between Brampton Road and Burford Road) from 8.30 to 9.30am and from 2.45 to 3.45pm on Monday to Friday during school term-time; and

(e) Kay Rowe Nursery School - pedestrian and cycle zone (H10) is in force in Osborne Road (between Richmond Road and Woodgrange Road) from 8.30 to 10.00am and from 3.00 to 4.00pm on Monday to Friday during school term-time.

4. Exemptions apply to:

(a) pedal cycles;

(b) virtual access permit holders;

(c) taxis (in relation only to paragraphs 3 (d) and 3 (e) above);

(d) refuse collection vehicles; and

(e) vehicles being used:

(i) for ambulance, fire brigade or police purposes;

(ii) in connection with the removal of an obstruction;

(iii) in connection with the cleansing, maintenance, improvement or reconstruction of the carriageway;

(iv) in connection with the placing, maintenance, improvement, reconstruction or removal of street furniture;

(v) for the purpose of any building operation or demolition; or in connection with the laying, erection, alteration or repair of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any communications network; or

(vi) for the provision of a universal postal service.

5. Virtual (electronic) access permits are granted without charge to those occupiers who keep vehicles at addresses within the pedestrian and cycle zones.

6. Copies of the Orders, which will come into force on 11 July 2022, and documents giving more detailed particulars of the Orders are available for inspection during normal office hours at Newham Dockside, 1000 Dockside Road E16 2QU, by telephoning 020 3373 6415 or emailing traffic.orders@newham.gov.uk, for a period of six weeks from the date on which the Orders were made.

7. If any person wishes to question the validity of any of the Orders or of any of their provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirement of the Act or of any instrument made under the Act has not been complied with, that person may, within six weeks from the date on which the Order is made, apply for the purpose to the High Court.
