COVID-19 RELATED SAFETY MEASURES – WILLIAM MORRIS PRIMARY SCHOOL, MITCHAM

THE MERTON (PEDESTRIAN AND CYCLE ZONE) (RECREATION WAY) EXPERIMENTAL TRAFFIC ORDER 2020 VARIATION ORDER 2021

1. NOTICE IS HEREBY GIVEN that the London Borough of Merton, on 5 May 2021, made the above mentioned Order under sections 9 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, and all other enabling powers.

2. The general effect of the Variation Order will be to vary the Merton (Pedestrian and Cycle Zone) (Recreation Way) Experimental Order 2020 (as modified), so as to increase the extent of the pedestrian and cycle zone in Recreation Way to that specified in column 3 of the Schedule to this notice and which includes the length of Recreation Way between Huntingdon Close and Kent Close. Any motorised vehicle will be prohibited from entering the length of Recreation Way specified in column 3 of the Schedule to this notice, during the corresponding periods specified in column 4 of the Schedule to this notice, with an exemption for those authorised vehicles which are specified on a whitelist held and maintained by the Council.

3. A copy of the Variation Order, which will come into force on 14 May 2021 and may remain in operation until 7 April 2022, of the original Experimental Traffic Order, of the modification which took effect on 22 January 2021, of a plan of the relevant area and of the Council’s statement of reasons for making the Order can be inspected on-line at: https://www.merton.gov.uk/covid-19-transport-projects until the original Experimental Traffic Order ceases to have effect or during normal office hours on Mondays to Fridays inclusive at: Merton Link, Merton Civic Centre, London Road, Morden, SM4 5DX.

4. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court.

5. The Council of the London Borough of Merton will consider in due course whether the provisions of the original Experimental Traffic Order, as modified by the modification which took effect on 22 January 2021 and varied as described above by the Variation Order should be reproduced and continued in force indefinitely by means of an Order made under section 6 of the Road Traffic Regulation Act 1984. Persons desiring to object to the making of the Order under section 6 of the said Act of 1984 for the purpose of such reproduction and continuation in force may, within a period of 6 months beginning with the day on which the Variation Order comes into force, or if the experimental Order is varied by another Order or modified pursuant to section 10(2) of the said Act of 1984, within a period of 6 months beginning with the date on which the variation or modification or the latest variation or modification came into force, may visit https://www.merton.gov.uk/covid-19-transport-projects and do so, or send a statement in writing of their objection and the grounds thereof to the Head of futureMerton, Environment and Regeneration, Merton Civic Centre, London Road, Morden, SM4 5DX quoting reference: ES/SCHOOLSTREET and the name of the relevant road.
