HIGHWAYS ACT, 1980— SECTION 116 AND SCHEDULE 12
NOTICE OF INTENTION TO APPLY TO STOP UP A HIGHWAY, MARY ROAD AND PART OF MARION ROAD AND ASSOCIATED PASSAGEWAYS, BOOTLE
NOTICE IS HEREBY GIVEN THAT the Council of the Metropolitan Borough of Sefton, the Highway Authority for the highway hereinafter mentioned intend to apply to the Sefton Magistrates’ Court sitting at The Law Courts, Merton Road, Bootle on Wednesday 30th September 2015, at 1.45 p.m. for an Order under section 116 of the Highways Act 1980 authorising the Stopping-up of the below listed highway on the grounds that it is unnecessary :-
The Area of Highways, Mary Road and part of Marion Road and Associated passageways, Bootle .
The effect of the Order will be to extinguish all public rights of way over the said land.
A copy of the draft Order and Plan may be inspected free of charge at the Council offices of the Head of Regulation and Compliance, Corporate Legal Services, Magdalen House, 30 Trinity Road, Bootle, Merseyside L20 3NJ between the hours of 9 a.m. and 5 p.m. Monday to Fridays ( excluding bank holidays and public holidays ) from Wednesday 19th August 2015 until Wednesday 30th September 2015.
The area of highways to be stopped up are shown hatched black on Plan No DC1360g ;-the whole length of Mary Road, and passageway leading from Mary road to Eleanor road previously adjoining the now demolished properties numbered 2-48 (evens) Mary road and 1-51 (odds) Eleanor Road and 35-43 (odds) Springwell Road and 82-92 (evens) Monfa Road Bootle. Passageway leading from Mary Road to Marion road previously adjoining the now demolished properties numbered 1-47(odds) Mary Road and 2-48 (evens) Marion road and 45-57 (odds) Springwell Road and 94-106(evens) Monfa Road, Bootle. That part of Marion Road commencing from its junction with Monfa Road and leading in a north easterly direction for a distance of approx. 87m. Passageway leading from Marion Road, previously adjoining the now demolished properties 1-19 (odds) Marion Road and 108-112 (evens) Monfa Road, Bootle.
Any person to whom this Notice has been given or who uses the highway specified or who would be aggrieved by the making of the Order may appear before the Magistrates’ Court to raise an objection or make a representation on the application. ( Any person intending to appear before the Magistrates’ Court at the hearing of the application is requested to inform
